Sir, The problem is with the Insurance company. They ought to give you for the damages incurred especially in a new car.

As mentioned before by others, it is not easy to pin a manufacturer for manufacturing defect especially in a country such as ours.

Also, the private insurance companies are not too helpful in such situations.

One suggestion is to take either of them to consumer court! Atleast a legal notice would move forward!
