Yes. This does happen. The law holds the current owner responsible for any problems with the paperwork, regardless of whom you bought it from.
It's important to take a look at the amount of duty paid at the time of import, and the declared value of the bike. If the bike in question is an almost new R1, but the books show it valued at 1.5lakhs, stay away. It could lead to problems later, as it is obvious that the bike has been grossly undervalued. Hence, the owner, if caught, may have to pay the balance duty along with a hefty fine or risk losing his bike to the DRI.
