Agree.Wasting time and money on law suites and patent settlement, than investing them on R&D and greater technology for humans ,is ridiculous.

I recently read some article which detailed more about this and why google bought Motorola to get more hold to bigger telecom patents.

The sad part is, the overall company operational cost increases with all these things and we will end up paying higher prices for all these non-senses.

Apple is going overboard. One of Apple's customer posted his email conversation with AppleCare on his blog and Apple sends him a warning to remove the email thread !

Email thread is here: Warning: Check Your AppleCare Support Profile! | Go Inside Magazine

Its pretty harmless and just normal interaction. Apple's contention is that email had this disclaimer:
“This transmission may be privileged and may contain confidential information intended only for the person(s) named above. Any other distribution, retransmission, copying, or disclosure is strictly prohibited. If you have received this transmission in error, please delete this message from your system.”

Well looks like they are going to use the $97.6 Billion that they have in the bank to sue other companies out of business.

I can feel for them on some of the cases, but on others they seem to have gone over-board.

And meanwhile, Apple had a pretty awesome week at the German courts.

From Foss Patents:

--------------------------------------------

Mannheim court throws out third Samsung 3G lawsuit against Apple and one of two slide-to-unlock lawsuits against Samsung

Samsung still hasn't been able to enforce any intellectual property right anywhere on this planet against Apple, while Apple has had some successes (though only preliminary ones so far, most of which were subsequently lifted).

--------------------------------------------

Apple wins German injunction against Motorola over photo gallery patent

If Apple enforces the ruling, it can even require Motorola to destroy any infringing products in its possession in Germany and recall, at MMI's expense, any infringing products from German retailers in order to have them destroyed as well.

--------------------------------------------

Motorola can't enforce standard-essential patents against Apple in Germany while appeal is pending -- huge victory for Apple, bad news for Google

Apple scored a breakthrough court victory today against Motorola. Its importance can hardly be overstated. This is so huge that it even begs the question of whether Google's strategy for its $12.5 billion purchase of Motorola Mobility has failed before the deal is even formally closed (they're still waiting for some regulatory approvals).

Most of the patents that telecom firms get regarding core wireless technologies are declared during standardisation. In fact when we propose a standard, we are supposed to be mention the patents we may have in those areas and accept fair licensing.

Consumer facing/device patents are not like that which is fine since its not standardised and hence they need to protect them and have fun

Here's a good summary article:

Apple's War on Android - Businessweek

look at the observation on last page:

"In the short run, the tech giants could save themselves considerable legal fees and distraction if they were to lock their lawyers in a hallway of conference rooms and refuse to release them until they had crafted a series of comprehensive cross-licensing pacts. This process eventually resolved similar litigation in the desktop computer field. Such a solution “is still probably what will happen here,” says Stanford’s Lemley. “But in the meantime, these companies have paid their lawyers more than $400 million” over the last several years. “It’s not clear what they’re getting for that money.”

Now Microsoft buys AOL's patents at $1.3 million per patent. Microsoft's licensing covers 70% of Android phones.

Each smartphone is estimated to be exposed to 250,000 potential patent claims.

Well be prepared or you may be sued that your shoe design is copied.

I do not think we have heard to last of the Apple - Samsung saga. There are many chapters to come.

I am wondering that with Android under a cloud are Microsoft and Blackberry rejoicing?

Very sad that such a cash rich company is spending so much money and resources to protect its designs as against encouraging more innovation in the name of better technology for humans.

OT: Even sadder to know of the huge pharma patent scam that US is imposing on the rest of the world. These are human lives for Gods sake!!

Copying doesn't encourage innovation. It just ends up in commoditising a market to the point where the only differentiator between brands become incremental differences. Take a look at the TV market where there is little reason to upgrade your sets or move between a Sony and a Samsung. It's the same thing with the Windows PC market where there's little to choose between a Dell, a Lenovo or an Acer. If everyone's the same and all innovations can be cloned in a few months, brands end up fighting on price and the need to truly innovate becomes less and less important. In contrast, look at the Lumia which shows how one can create a smartphone without cloning another one. It's a different vision of the smartphone experience from iOS or Android and therefore offers a real choice to consumers That's what encourages innovation, not copying.
