I would suggest what others have already suggested. Try and meet the MD. If he is not available, send him a registered letter giving 30 days to refund the remaining amount else you will go to consumer court claiming refund+interest, compensation for harrassment and agony and will pray to court to penalise the dealer for cheating.

i'd say try to get someone who knows the MD there. Someone on the forum could help. Talk to him and settle with some expenses for him for coming down to tvm. Its always better to solve it ASAP with minimal damage. A police case would take years to get some outcome.

Update!

His cheque bounced. I didnt know this happened until he calls me up and tell me that he is in a fix

After making him call me couple of times and talks with my cousin, he is ready for whatever I want

I am thinking of getting accessories since he can give money only by sept!

He said he can get me Carry Boy bull bar.

I havent seen one of these and hence can anyone post a pic of this?

Or, I can ask him for seat cover + a pair of Bosch Europa.

What say?

You have them, JKD and you can give them sleepless nights. Bouncing a checque is not a petty offence anymore.I'd suggest you to threaten them with legal action,unless the pay up the full amount in Cash/DD. And use the money elsewhere, to splurge on accessories.

He said he can give money from his account by only by Sept. I asked him to give a cheque for that amount too!

Since he can only pay the extra money by Sept, the idea of getting accessory came in. He said Carry boy costs 12k, is it?

I am not sure about Carry boy, so cannot comment. But is it going to serve any purpose other than adding to the looks? Its fibre Glass, I guess?

I'd suggest you to take atleast a promisary note, in case he cannot pay up before Sept, and if you are okay with giving them so much time. But frankly, i dont see any point why you should settle for anything less, after all, they are the offenders here, right? then why should you suffer?

You should consult a lawyer as i think the salesman is taking you for a ride. He issued you a cheque knowing fully well that he wont have the money till sept?

Why wont he have money till sept? he can take a loan from bank and bank guys have close relations with car salesguys.

jk, is he giving the 12k or not? Is he prepared to give anything in writing with respect to the 12k?

Now, you know my age and my lack of knowledge in such stuff

, but AFAIK, a case of cheque bouncing is easier to fight and prove in court compared to a consumer case. Force them to give everything back, or atleast to give assurance in writing. (Carryboy bull bar sounds nice too).
