Supreme Court quashes Fiat's plea to review excise judgement

The Supreme Court has dismissed a plea by Fiat to review a August 29, 2012, judgment, which had asked the company, along with its sister concern Premier Auto, to pay up around Rs 360 crore by way of excise duty on Fiat Unos sold between 1996 to 2001.

Common sense prevails!

Budget 2014: Fiat case resolved, pay excise duty on final sale price

Quote:
The budget has said that excise duty would be levied on the final sale price. The controversial Supreme Court ruling in the Fiat case had impacted the manufacturing sector, particularly automobile, consumer durables, FMCG and chemicals sectors, in a big way with the excise department raising retrospective tax demands on discounts given to customers.

By selling at a price less then cost price the manufacturer is already taking a risk/hit. This idea of taxing on production cost is incomprehensible.

If the manufactures pays the exercise duty on the the invoice cost does it mean customer now pays road tax on invoice cost as well?
