False Mileage Claims ??? now be sued
Times of India , page 6 :
A bike manufacturer was asked to pay compensation amounting to the cost of the bike + rs 11000 as damages to all complainants,as the bike purchased failed to live upto mileage claims.... the bike manufacturer stated that the bike gives 93kmpl in ideal conditions and 83kmpl in normal conditions ... actual mileage got by customers : 40kmpl.
the court held that these so called ideal conditions are a gimmick to sell draw in customers, since they are impossible to achieve in reality.it said the manufacturers are expected to know the conditions which exist in our country in which these bikes are likey to run. the court held that this was an UNFAIR TRADE PRACTISE.
finally the ball's rolling. finally action against deliberate misrepresentation
i reckon we should have a body like the EPA in the US (reference www.fueleconomy.com and www.epa.gov)
in the US it MANDATORY for each manufacturer to have a sticker with EPA's mileage estimates on the car in the showroom.
i reckon OD should be sued too

wow this is going to set a precedent, I hope it does! These guys need to be pulled up. I am generally against regulation, but the raw deal the companies give, they are definately in need of a nanny from hell

Did anyone notice that off late the ads have started quoting the auto mags numbers for the mileage with fine print about the source. Does that give them immunity over such claims since they are only quoting someone else?

Not just mileage, but many companies wrongly quote their horsepower ratings. That's why nowadays, many manufacturers have SAE (Society of Automobile Engineers) written beside their HP figures. In these cases a repesentative of SAE monitors the dyno when the official HP and torque figures are taken.
