Yes am aware of this however it seems to me that all these taxes are an effect on the ex-showroom price of the cars. However there is no mention of RTO tax being clubbed into this, seems that will independently be levied by states as over and above the ex-showroom price.

Some retired CBEC chairman stated at a seminar some months back that road tax won't be subject to GST. The word I have been hearing around is that similarly GST will not apply to property tax and stamp duty, two other major money spinners for the states even bigger than the LTT racket :(

GST is replacing only the Exise duty and the VAT. Road tax is not part of it's perview. If the road transport minister has his way he will have One time third party insurance, and remove the one time tax, his idea was to keep taxation period a option with 1,3,5 and lifetime as option with telescoping reduction to the purchaser.

I recently purchased a Skoda Laura from Telangana. I have the NOC from the RTO there and am currently in the process of getting it registered in Bangalore. But the tax is so expensive here that I have to cough up nearly 2 lakhs as road tax. I have a few questions if bhpians can help me with.

1. The car's invoice value shows 13.5 lakhs. But with VAT it is totalled at 15.19 lakhs. Is the road tax applicable on car value or car value with VAT? If it includes VAT then how can tax be applicable on tax (VAT)?
It is a 2011 model.

2. Is it possible for me to get a refund from Telangana ? If so then what is the procedure? Should I apply for refund after registering it in Bangalore or before? Or is it the previous owner who has to apply as he is a resident of that state?
The car was registered in Telangana only a year back.

3. There is a rumour going on among many RTO agents in Bangalore saying the new GST policy will abolish the state road tax rule and it won't be required anymore to pay lifetime road tax in other states if it's already paid once before. Can anyone shed more light on this? If so I'll be saving a lot of money.

Kindly put in your inputs and help me out.

17% of the invoice value pro rata (with some reduction for the car's age) but the RTO likely also has their own table of car invoice values that they may work from.

You have to -

1. Get the RC in your name after coughing up road tax - that will first be the original telengana number on your Karnataka RC. After a couple of months you can then apply to get a Karnataka number (or try to get it right at the beginning when you apply for transfer of ownership)

2. Take the changed RC information and other details to the relevant RTO in Telengana and apply for refund there. Search several posts back in this thread for a post from me describing how I got my Chennai RTO tax refunded and got a Karnataka number. Long long process, it will take you a few months and quite some amount of pillar to post running but the tax amount is substantial so well worth it.

GST will not touch property tax, vehicle lifetime tax or stamp duty. The agents are wrong and speculating on something they don't know about.

Nope. Once the NOC is issued that telengana RC is invalidated and you have to either

1. Get the telengana NOC cancelled and operate the car in Telengana (for that, get a NOC not in use certificate from the Karnataka RTO)

or

2. Get a Karnataka RC for the car

Need your perspective BHPians

I own a pre owned car. I now plan to move the car from Faridabad to Hyderabad.

1st owner: Invoiced for 6.4 lakh, HR 26(Gurgaon registration) in 2010
2nd owner: Me, got the car transferred to self in Faridabad, Haryana RTO with same registration number.

I am trying to know on what value will the Hyderabad state tax be calculated and for how many years. Will it be on 2010 invoiced 6.4 lakh value? And for duration will they charge just for remaining 8 yrs of life or the full 15 yrs.

Normally the tax is calculated on the prevailing road tax rate for the remaining years...that is 8 years in your case. They may add some penal charges if there is a delay in NOC issue date by the previous RTO and your application date in the new RTO.

Thanks Saket. I am clear on the tax rate that it will off-course be the current rate. But on what value of car will that be calculated on?

Hi,

Please help me!

I had sold my car to a buyer in Tamil Nadu, and had got a NOC. from M.P. for the same on 17.02.2017. (The car was bought in 2014 August and paid full life time tax of about 70,000/-)

The car got registered in TN and the owner has a new number given to him 2 weeks ago. I have a copy of the NEW RC and the new TAX receipt.
When I applied for Road tax refund, I was told that I am not eligible for a refund as I am applying for the refund more than 2 months after the NOC was issued. !!!

They even took out the Motor Vehicles act which states that one can not apply for a refund after 2 months of transfer to another state, but they are insisting that, that means it is from the date of issue of the NOC. Which I believe is clearly incorrect. It is all written in Hindi and though I am not very good with hindi I can clearly tell that it states from the date of transfer and no mention of NOC.

Is there anything I can do? Is there any Section in the motor vehicles act that I can refer to.

Can I file any a request to RTI for this??

Even they said it is not possible to get the car registered in another state in less than 2 months; But they just said they are bound by the rule in the book! And can't issue me any refund.

Could you post the relevant MVA language, or a picture of it?

The NOC claim is absolute BS, because no RTO will even entertain a refund request until proof of transfer is provided (i.e. a copy of the new RC). NOC is simply the source RTO endorsing the intent to transfer registration and has no legal validity by itself.

I would suggest you talk to the RTO (the officer, not the organisation) direct, not to any of the flunkies. If they don't budge, file an RTI.

Will contact him and let you know how it goes.

Will post a scanned copy of the rule they stated tomorrow as I will go and buy the "Motor Vehicles Act" Though I have a whatsapp photo,
and also they said will give me a photocopy of the rule with their rejection reply.

Infact, I spoke to the RTO himself, he said if the rule states that he cannot help it. :(
I really hope I can meet the Transport Minister next, but I dont know how even he can help me.

I think I should file an RTI, would just go thru the process of it and figure it out. Any help on that??

Isn't there anywhere that I can file a case against the RTO or this stupid rule.
