The channel us High Court (mandatory), then Supreme Court, then President, then back to the Supreme Court for one last time. So we will be lucky if the whole process is completed by the end of 2014!

Our legal system needs a complete overhaul, but that's akin to asking thieves to contribute to a police development fund. Never going to happen.

That being said, capital punishment (however deserved, as in this case), is not the end solution to this menace. These 4 will be hanged (and deservedly so), but what about the millions of men (the defense lawyer included) that mistreat/disrespect women on a daily basis? How many can/should we hang? To what end?

It might be a slow process, but education (not just formal) is the only way out. The "women are inferior" mentality is the ultimate basis of all these crimes, and this mentality starts at home most often. Until this mentality changes, no amount of punishment (capital or otherwise) is going to achieve anything in the long run.

We will all take solace in the punishment handed out in this case, get back to our lives, until we have the same debate on a similar thread and wonder what's wrong. It's 'Us' that's wrong. How many of us object to men disrespecting women in schools, offices, homes, streets, malls, colleges? How many of us teach our sons, younger brothers, students to behave in a manner appropriate to civilized society? How many of us ourselves treat our mothers, wives, sisters, colleagues, girlfriends, classmates with the respect they deserve? How many of us believe we're alright and it's the other men who need to learn and become better?

Whether we do our bit to change the world around us, or wait for another sensational case to express our justified but ultimately pointless righteous indignation is upto us. Take your pick.

I have always said that women's harassment is more of a cultural issue then a law & order issue. For most men it's perfectly normal to sexually harass a woman and that is exactly the reason why cops don't take these cases seriously because they after all also come from the same society. India is probably the only country that refers to sexual harassment as eve teasing which in my opinion is taking an extremely lenient view of this crime.

The way out of this is obviously to teach young boy's to respect women and you don't have to lecture your young son on this. There are subtle ways of doing that, something as simple as asking your son to fetch a glass of water for his sister or mother will go a long way in making him respect women & consider them as equal's.

What the human rights organisations don't understand is that India is a different country and people here are used to having someone standing with a stick ready to rap them on their heads if they go wrong. That is the reason we need a heavy deterrent like death penalty here. Even educated people will do illegal things if there are no cops watching. We see it happen everyday at every traffic light.

The day we start delivering strong & swift justice to cases of molestation & sexual harassment will be the time rape cases will automatically come down. Unfortunately, that is an aspect no one in the country is thinking about.

Of course, death penalty in this case will not reduce rapes. It's not because death penalty is not a deterrent but because criminal's know that it's a one off case and not much is actually going to change on the ground. Instead, start convicting more rapists & taking swift action on harassment & molestation's and you will see a reduction in crimes against women.

There are solution's to this epidemic but none are quick fix ones. You have to take a two pronged attack of cultural education & sensitisation of the male population and stronger & swifter legal system to really see a change.

And of course, we have to change that idiotic juvenile act. Guy's are now actually claiming that they are minor's after raping women. It happened twice in the Shakti Mills rape cases and it's happened again in Assam today (Gang Rape in Assam. Accused claim to be minor's) Criminal's are aware of this escape route and are using it now.

Precise point. Judicial system has no credibility, it lives on borrowed (??) credibility. If anybody questions any judgement, then it is a contempt of court. The system in its present format is completely against common sense and laws of nature (simple rights and wrongs). It is a system not open to questioning.

Judgments like this (and many others) embolden other criminals, thugs, rapists and terrorists to carry on with impunity. Remember the lines from "A Wednesday" - tum kuch bhi karo, hum aise hi hai! (terrorists continue with bomb blasts).

Have you made mistakes with numbers? 2014 or 2024 or even 2034. The system is nothing but a joke!

That's precisely how this system was designed to be in colonial times. No accountability for the bureaucracy was built into it to protect the existing hierarchy. Beneath all the hoopla of gaining independence, our lawmakers conveniently adopted the same system, and are reluctant to make any changes that are progressive, enhance systemic accountability or in line with the times we live in.

Even today, our top investigative body reports to the Prime Minister who has a vested interest in derailing their job (despite several requests for autonomy), Chief Ministers have a say in appointing the state Ombudsman (Lokpal), the Supreme Court is disobeyed and defied with impunity and every case of wrongdoing by the bureaucracy is filed under "conspiracy by rivals" and conveniently forgotten.

Apologies for going slightly. This subject just grinds on my mind.

The guy who mercilessly raped, bit into tender flesh and pulled out a young girl's intestines is now getting trained to cook and stitch, gets to enjoy chhole-bhature for breakfast, puris for lunch and is served paneer for dinner. Life inside a 'home' is much better than 'facing reality' outside, eh?

how many 'juveniles' are getting encouraged to commit similar crimes to escape the harsh realities of modern Bharat?

I just read this:
http://articles.timesofindia.indiati...tion-five-boys

Excerpt copied from the above article in TOI:
Quote:
A 12-year-old girl was allegedly gang-raped by five minor boys in the Hatigaon area here....
The five boys aged between 12 to 16 years, who are her neighbours and play together, called her outside her house and then gang raped her, according to the FIR filed by the mother at Basistha police station.
The boys must have been influenced by the Delhi case. They knew that they would be free after 3 years (since the time spent in the juvenile centre during trial is also included in the sentence).

I remember one scene from Robot: Aishwarya and Rajnikanth go to a beach, where a goonda guy tries to kidnap Aishwarya. Rajnikanth threatens the goonda saying he'll be put in prison for 10 years. Goonda says he won't mind spending the rest of his life in prison after getting this kind of fun!

AP Singh, the Lawyer is in trouble for his remarks. Kudos to bar council for taking up this matter. See article below

The Mumbai case juvenile will join him and they will plan many more such atrocities. Or may be open a coaching academy. Judicial system and jholwalas should be ashamed of what they have created.

Death Sentence convicts are not usually granted bail, being out on bail is extremely rare(read impossible).

According to Delhi High Court website update , Death Reference no. 6/2013, reserved for judgement.

Till the sentence is actually announced in court, it cannot be said that they have been sentenced to death. Mods may please change the headline as it is misleading.

Even after death sentence is announced, the guilty have recourse to multiple appeals to court & appeals for pardons (i.e. reduce to life-imprisonment) etc. So if the guilty or their lawyers do all the paper work necessary, it will take some time before he is hanged.
