Actually, if the victim is minor, then consensual or not, Shiney is in big soup

But the law is a little weird.

Adultery
Quote:
Section 497 penalizes sexual intercourse of a man with a married woman without the consent of her husband when such sexual intercourse does not amount to rape. That is, it draws a distinction between consent given by a married woman without her husband’s consent and a consent given by an unmarried woman. It does not penalize the sexual intercourse of a married man with an unmarried woman or a widow or even a married woman when her husband consents to it. In case the offence of adultery is committed, the husband cannot prosecute his unfaithful wife but can only prosecute her adulterer. However, since the offence of adultery can be committed by a man with a married woman only, the wife of the man having sexual intercourse with other unmarried women cannot prosecute either her husband or his adulteress. What is interesting here is that the section itself expressly states that the unfaithful wife cannot be punished even as an abettor to the crime. The offence of adultery therefore is an offence committed against the husband of the wife and not against the wife.

You can say that again.

So a wife as per this is nothing but the personal property of the husband. When was this Law passed? A gift of the Empire i guess.

You need to read the rule very carefully.
The only one who can be deemed guilty is a man who sleeps with a married woman without the consent of her husband.

The law is there as a detriment to adventurous men.
Its not there to save women or morality or anything.

Indian law is a pull over form the earlier Victorian era.
While they have moved forward we are still in the middle of it.

For example:
A gay male couple can be arrested, but lesbians are outside the law.
This is another law I despise.
Not because the women get free, but because it takes away the right to choose a lifestyle by the person living it.

If I had the option to define law. Rape would be on par with Murder.

Not so-Shining Ahuja arrested under Sec 376 and will remain under Police custody till June 18.

Doing something behind close doors and that too his own doors was his safest bet. Ahuja thought by bribing her or something he can keep her quiet.

Whatever may be the reality, what he did was very shameful.

This line is a bit confusing, In this sentence does WIFE refer to the adulterers wife or the person with whom he has committed adultery.

This is an opportunity to make an example for the Indian Judiciary (much mailgned, sometimes rightly so I guess)- if Mr Ahuja is guilty, he should get the sentence prescribed by the law (worse if the lady in question is a minor), if not the persons behind the false accusation should be prosecuted (Is there such a provision in the law? bblost, care to enlighten us on that??)

At worst, this is an example of the above-law, larger-than-life, get-away-with-anything lifestyle that prominent public figures in India lead; at best, an afternoon tryst gone wrong. Unfortunate thing is, in the time of slow news, this will be exploited to the hilt by the predatory, unrepentant and sensationalist media. Ummmm.....why are we discussing it here, by the way?

well a medical test has confirmed "sexual assault" including the presence of injuries. So if the sex was consensual then it was pretty rough!

Happily married or not is besides the point and junior artistes/maids give the opportunity for casual flings which an affair with a more well known face may not provide. And Shineys wife was away in New York for the past 2 months and hence "unavailable". Sex is a basic instinct and such basic instincts can often make people do things in a moment that they will regret for the rest of their life.

in any case, shiney had a less than stellar reputation inside bollywood. His lawyers are now playing up the angle of consensual sex and the "she initiated it" angle: basically the old angle of loose morals etc.

Hope he rots in hell.

the mumbai police deserves to be congratulated for the stellar manner in which they are proceeding to ensure that Shiney doesnt get away using loopholes in the law.

They have taken the unprecedented step of not only getting both medically examined but also another test done by the Forensic Science department which has confirmed rape. This ensures a watertight case against him.

Now if only the police showed the same enthusiasm in every case.

I was taken aback when I found that the famous Yeti started this thread !! This is because I personally did not find the subject to be worth a "breaking news" in team-bhp. This is not the first or last time our bollywoods guys get into these things. Or is it that Yeti knows this guy personally and was therefore shocked ??

Coming to the subject, confining to the issue of cheating on his wife, this guy is not the first one to do it among these overrated film stars. He has illustrious predecessors and seniors in the game. Amir, Saif lead the pack among the modern era of actors. Only they picked up people higher in the social status ladder.
