Consumer court fines Key Tata Showroom, Bengaluru for selling car previously involved in an accident

A small time independent journalist aka Vijaya times has managed to cover the incident a Tata customer in Bengaluru has gone through. Surprisingly none of the big media houses seem interested in issues like these anymore. I guess that's what happens when print and digital media relies on corporate money to run its business.

Anyway, the crux of the matter is as follows:

A customer who happens to be a doctor in the video walks in to drive home his Tata Nexon from Key Tata at Kanakpura, Bengaluru.
He noticed from the very first day after delivery a bunch of things he should have checked during PDI (which I think he never did).

The car had misaligned rear door, rusting everywhere, some chassis bits looks to have been welded or repaired, boot was repainted and you can see the old and new paint there clearly. The left side of the car was also repainted. Ac pipe rubber was damaged and the customer noticed foul smell and hot air even with recirculation on, the engine bay insulation was also removed, engine bay wires were just free hanging etc. Customer says he went on a long drive after switching off ac because of the foul smell and then noticed fuel smell coming through ac vents, door sensor unlocking at speed by itself(shown in video) etc.

Realising the car wasn't worth the trouble anymore the customer contacts the dealership owner to sort this out and the dealership owner decided to ignore it. So he sent mails to Tata senior executives themselves and they too ignored it.

Finally the doctor approaches consumer court with a lawyer and the lawyer takes opinion from independent garage owner who highlighted more flaws with the product as you can see in the video below. It was determined that the car sold was involved in a major accident and the dealer repaired it and sold it to this customer. The dealer was ordered by the consumer court to compensate the owner for Rs 18,00,000 and to fix his car and give it to him a few weeks ago. The dealer had agreed to compensate the owner in front of the court but has still not paid the customer even now allegedly.

Same Key motors tried to sell repaired Tata Safari (top variant) to my colleague. There were signs of repainting at multiple locations, ill fitted parts, scratches, and soiled interior. All were caught during pre registration inspection and we rejected it. Dealer behavior was bad and they did not admit their wrongdoing. Finally we had to take car from different dealer (even that was not a good experience).

I had posted this on the Tata Nexon thread a week ago, also tried to reach out to that person through email. He is not a doctor but doctorate holder and works in something related to 3D printing.

Many moons ago, Key motors service at Konankunte cross was excellent. Might I say, best in Bangalore. The service went to dogs when they started taking in cars for service like herds of sheep. Sad to see that their dealership arm also has poor reputation.

Tata needs to make strict policies for dealerships. Most of the problems with Tata are due to their pathetic dealership personnel.

This is because of the ASS team of car makers getting kickbacks from dealerships. How often do we come across Maruti dealerships involving such incidents?

Complete responsibility lies with the customer. Absolutely his mistake. He shouldn't have trusted any of Tata dealers. Many Tata dealers have been consistent in fooling people from Kashmir to Kanyakumari and Gujarat to Arunachal. I fail to understand why companies don't cancel the dealership of such fraudsters. Or may be they're the silent partners in the crime.

I've been a victim of such innocent acts by few Tata dealers in the past and have already decided to never buy a Tata again even if they have best of cars. Incidents like these help me feel good about my decision(though I feel bad for the doctor).
I'll still count him lucky that he'll not be going to a Tata dealer to get robbed again and again at every service.
Hope he gets the compensation ASAP and goes to a better option next time. All the best to him

The perception I get is that Tata dealerships and ASS have the worst service and lack honesty in their dealings. For other brands, the companies usually step in when there are such issues but not Tata, at least not without the court getting involved.
But I fail to understand why Tata does not maintain standards. What value do they see in letting rogue dealers spoil the company's reputation? Or is the idea that since their cars are selling, it's not worth the bother to try fixing these issues as there doesn't seem to be any negative impact on sales?
Again, reality may differ but this is the perception I and probably a lot of other people have.

Lately, dealers are not encouraging customers to bring third-party people to inspect cars during PDI. Unfortunately, dealers are changing their tone after all formalities are completed. One such incident happened at Anant Cars recently when a customer was not allowed to bring an expert for PDI at their stockyard in Kengeri.

Maybe a law or some direction from govt should happen. When you pay for a product, its ones right to make sure you get what is being promised. Customer is willing to pay for PDI and not sure what the dealership loses in this.

Kudos to the lone ranger Vijaya Times, who made public the fraud, misrepresentation and cheating by Key Motors, Bengaluru, to which the doctor fell prey to.

A court order is an order to be followed by the concerned person be it the applicant doctor or non-applicant Key Motors. There is a window of 90 days for Key Motors if it wants to appeal to a higher court of law. Also the doctor has a 90 day time to file for contempt of court in the same consumer court.The 90 day window for filing contempt applies if theres no mention of any time period in the consumer court order for compliance. Many a time the bench in a consumer court issues an arrest warrant to nab the contemnor in such contempt cases, if its orders are breached.

Also, the doctor first of all prior to moving the consumer court should have filed a FIR against Key Motors in the appropriate police station under Sec 318(4) of the Bharatiya Nyaya Samhita Act for cheating.

The concerned civil court can be informed the details about such a FIR pending for investigation with the police.
