Supreme Court bans 15-year old petrol & 10-year old diesel vehicles in Delhi-NCR

Supreme court has recently ruled in favour of a ban on vehicles of petrol 15 years old and 10 years old diesel vehicles

Let's take a route where we throw all available solutions which use quantitative and scientific measures in the air and make arbitrary rulings based on age. If we extend this logic, maybe some of those judges may not be fit to serve in the Supreme court at all because you know, old is bad. [/sarcasm]

Instead of creating a strong pollution control body, pushing manufacturers to match global emission norms or encouraging customers to keep their vehicles in proper condition, we have moved the problem, the goalpost and the goalie to an age-based model.

I am really looking forward to half of commercial transport in that area being grounded because of this. And then a strike will happen. And then the ruling will be protested and overturned. Good for them.

Is this ban applicable for only Delhi state or all of NCR, like Gurgaon, Noida, Faridabad etc?

Is this ban applicable on two-wheelers as well? I have a Bajaj Classic SL scooter (bought in the year 2000) which I use sparingly for 1-2 km household chores.

What happens to vintage & classic cars under this regulation?
Or even cars that aren't classics yet but hold a lot of sentimental value / on their way to becoming classics like the Mercedes W124/126?

Would have been better to have a proper fitness certificate methodology, or make this ban applicable only for commercial vehicles which are more neglected and polluting irrespective of age.

Hello and welcome to India! You must be new here

It is far easier for us to create a new law (bonus points if it's a ban), than to do something hard like enforce emission checks and vehicle inspections.

I feel your pain, because I too wish we had a better vehicle inspection and fitness programme than the farce that is in force today. Something like the UK's MOT test.

Keep it, use it and deal with the consequences if caught (e.g. a fine + order to scrap). Don't be an eager beaver and scrap it just because of the ruling. Trust me, you'll feel bad when you see that you've scrapped your scooter but other polluting heavy vehicles and commercial vehicles continue to ply.

Ideally the use of such cars should be restricted - i.e. between 7PM till 7AM on normal week days and unlimited use on weekends and government/local holidays.

The Ban should be only on those vehicles who fail the fitness test,it should be mandatory for vehicles which are more than 10years old to get a fitness check done every 6 months,simply ordering a ban is not the solution.
Many people love their old vehicles and keep it in pristine conditions,it will be unfair for such people to scrap their beloved vehicles,Supreme court should do a re think about their decision.

Forget 10/15 years or failing fitness tests, Delhi might go for a complete private vehicle ban from Nov 1 if situation worsens!

What an absurd decision!

What about road tax paid by the owner? I believe it is for 15 years when the vehicle is registered, right? If 10 year old cars are going to be banned, shouldn't the owner get a refund?

Will the owners of the banned vehicles be able to sell them to buyers from other states

EDIT: just saw the post above that they are considering banning private cars entirely. This is only a stop gap - what needs to be done is find a way for the common citizen in the region to buy alternate fuel vehicles at affordable prices (exempt duties & taxes on EVs?) and provide infrastructure by means of charging stations etc

It's across ncr, but the maximum enforcement will be, as usual, in Delhi. For the rest, it's luck if the draw, and you know that the cops would be more interested in lining their pockets than going to the trouble of seizing your car outside Delhi.

From what I heard the other day is that the central government may amend or introduce a new motor vehicles act to mitigate the effect of the NGT ruling banning vehicles in NCR region.

It would likely be a blanket rule, no fitness for first 2 years, then once every two years till 8 years of vehicle age, and once a year every year after that. Also, cash for clunkers policy may also be introduced.

As we head into the election year 2019, there is a likelihood that the central government may try to appease those affected by the far reaching NGT/SC order.

If I remember correctly, there was an exemption for vehicles of a certain vintage.
