Re: Delhi Transport Dept tells Dealers to stop "Handling Charges" SCAM. EDIT: Telangana and Kerala t

I don't know about other Mahindra dealers, but the one in Mohali seems decent.
I have not purchased any Mahindra product till date, so my experience is to be considered with a pinch of salt.

1.The dealership is well maintained, though entrance is a bit clumsy due to bad patch of road primarily.

2. One doesn't have to wait even a second, since there is a receptionist right at entrance to escort you.

3. The pricelist is very transparent, with no compulsory charges. Infact it is clearly displayed in showroom that buyer can take insurance on their own.

4. The insurance quote by dealer is decent too. Extended warranty is optional too.

5. I once booked Thar with them online. They insisted upon insurance and registration will be done by them. I contacted Mahindra, within 2 days I got a call that I can opt my own. Different story altogether, I cancelled the thar though.

Attached ScorpioN price lists.

Re: Delhi Transport Dept tells Dealers to stop "Handling Charges" SCAM. EDIT: Telangana and Kerala t

When I went to buy a car, there were lot of dealerships who were charging handling charges but after a few rounds of negotiations and making then aware of the Supreme Court's verdict, nearly all of them dropped the handling charges in their final quotation.

Great that we have a supreme court to support us in India. In USA this is a rampant scam. Its an accepted norm here that destination charges worth lacs has to be paid by the customer. Post covid all dealers are charging over MRP. 5000-14000 usd above mrp.

Re: Delhi Transport Dept tells Dealers to stop "Handling Charges" SCAM. EDIT: Telangana and Kerala t

My Honda Brio car bought from Magnum honda, Bengaluru in 2012 has a logistic fee of 6,500 RS which is un-necessary and must have never been levied.
Thanks to the forum, i am none the wiser and seeking a full refund of the amount.

The dealership V.P arrogantly told me nothing can be done and is just giving me the run-about and engaging in whataboutery.
Also, the C.R.M at Honda cars has been as useless as ever apart from sending automated mails.

Can someone help with a recourse here and give senior contacts of Honda Cars?
I would like not to go ahead with the slow, boring bureaucracy of the KA consumer court, as i recently underwent a surgery.

Any tips or assistance is most appreciated.

If you have bought the car in 2012 and wish to file a case now, it would be rejected as the time period for filing a consumer case is 2 years from the date of occurrence of deficiency of services or illegal practices.

Re: Delhi Transport Dept tells Dealers to stop "Handling Charges" SCAM. EDIT: Telangana and Kerala t

So, are handling charges still illegal? The Toyota dealer im dealing with is not budging and says the charges are official now. You can also email Toyota about the same and they will confirm.

I think he is taking me for a ride and would like to brief them about the same once my car is delivered.

Another thing is, as they are the only dealership in the 50 kms radius, if customer doesn't agree, they simply allocate car to another customer.

Nov 2014 Booked a Scorpio from Koncept Mahindra, Lajpat Nagar, Delhi

Dec 2014 Vehicle arrived and told to pay the balances of payments.

Objected to the Illegal handling/logistic charges of Rs 7500, Dealer said this was a valid charge as per a positive court order in favor of them.

Jan 2015 Vehicle delivered but unconvinced of the illegal charges wrote to Mahindra who forwarded my issue back to dealer. They produced a court order but upon reading the content it was a irrelevant order to my cause.

Wrote back to Mahindra but no solution as they supported the Dealer.

Now turned to the Delhi Transport Dept but no respite as they directed me to an RTO out of Jurisdiction, The MLO heard my complaint verbally and said he will look into it.Further follow up resulted in no result.

May 2016 filed a case in the Delhi Consumer Forum against Mahindra and Koncept Automobiles, what normally would be a 2-3 year time period turned out to 6 long years due to Covid and Delhi Govt's Non appointment of Members/President to the Quorum.

During the case Mahindra dusted itself off from any responsibility as it stated that this is btw the Customer and Dealer and have received any part or share of these charges and also acknowledged that these charges are illegal in nature.

Dealer produced a letter written by Mahindra which was vaguely acknowledging that its aware of dealers collecting such charges and to address the RTO

Mahindra later issued a notification advising all dealers pan India to stop collecting such illegal handling/logistic charges

June 2022 The case was completed and orders issued as follows:-

Dealer to return Rs 7500 with 9% interest from date of invoice

Dealer to pay Rs 2 lakh as compensation or penalty for mis leading the Forum that Mahindra allowed them to collect these charges (within 2 months from order else a interest of 10% till realization)

Mahindra may also consider for cancellation of its dealership of its products as Koncept Mahindra has tried to put blame on the manufacturer.

The Transport Dept, Govt of Delhi has to take necessary action against the Dealer for undue charges.

Its been around 40 days so far and no response from Mahindra or Dealer, so what should i do hereon, any suggestions or advice
An update on my case regarding the illegal handling/logistic charges against Mahindra dealer Koncept Automobiles:-

The dealer has appealed against the District Consumer Forum Order but the State Commission has dismissed the appeal on grounds of delay, so next step maybe an appeal at the National Commission level, for now I have moved two steps ahead and two more to go.

Hats off to your perseverance and take it to the highest level .

This ruling could be a landmark for other similar cases in India.

Latest Update, after case being dismissed by the State Commission, the dealer has approached the National Consumer Forum for a revision petition .

Just 2 days back i.e. on 31st May 2023, the Revision Petition filed by Koncept Automobiles (Mahindra Dealer) has been dismissed in the Hon National Consumer Dispute Redressal Commission, was looking to update the post after receiving the certified order copy. On 10th April a date for hearing was given for August end, but the dealer's panel of lawyers moved 2 early stay applications stating apprehension that RTO might issue order to cancel their Trade License and date was given on 26th May and arguments were heard on 31st May 2023.

So likely the Mahindra Dealer will next move to appeal at the Supreme Court and/or may move the High Court for a Stay in case RTO takes any action in the meanwhile.

RTO had only issued 2 show cause notices so far (last on March 2023) to Dealer but not taken any actual action. All my communications from March by 56nos emails, 5nos Delhi Public Grievance Complaints to Delhi CM, Transport Minister, Transport Commissioner, Concerned Zonal incharge Dy Transport Commissioner/DTO/MLO, DTO-Registration, 6times physical visits to the concerned Zonal office have not yielded any results so far and majority times they do not respond. Meanwhile Mahindra and the RTO has approved and the dealer has opened another Showroom on the 30th April 2023, 6 kms away from present one at Okhla. The only progress in this case is being done by the courts so far. So lets hope for the best and a positive ending. For now the heat is on the Dealer to save his dealership all for Rs 7500 he illegally charged me as Logistics Charges.

Exactly what he deserves. I hope there are other customers who have been charged, can join you and make it a class action. That will burn the dealer and Mahindra further IMHO.

Re: Delhi Transport Dept tells Dealers to stop "Handling Charges" SCAM. EDIT: Telangana and Kerala t

Have recently booked an i20 N line in Delhi through Koncept and so far none of the line items on the pricing sheet or booking form have any handling or logistics charges mentioned.

Will update once I am getting delivery of the car.

Class action suits are not possible in India.
Mahindra has pan India has asked dealers to not levy any illegal handling/logistic charges from 2017 possibly due to post my case filed in 2016 as they were Respondents No 2
