A consumer court has asked carmaker Tata Engineering to provide a customer, whose Tata Indigo car had manufacturing defects, with a new car and pay Rs 30,000 as damages and to reimburse repair costs.

“The car had problems and snags from the day it was purchased...the opposite parties are liable to replace the same with a new vehicle and fresh warranty and pay Rs 30,000 towards repair of the car,” Consumer Disputes Redressal Forum (North) comprising President K. K. Chopra, Members Neeru Mittal and R. K. Prabhakar said.

Complainant Deepak Goyal, a resident of S. P. Mukherjee Marg, had purchased the car on July 2, 2003 and took its delivery four days later. The vehicle stalled on his way back home from the showroom and he had to take it the nearest authorised workshop for repair.

Mr Goyal had to put up with this state of affairs for almost two years before filing the complaint before this court.
During the hearing, Tata denied that the vehicle had any inherent manufacturing defects and said that repairs were done only after the vehicle met with an accident in 2005. It further argued that Mr Goyal had used the car for commercial purposes. However, the court dismissed Tata’s contentions on perusing the repair bills, dating back to the day of purchase of the car, placed before it.

Hope it was a genuine case.... and that serves TATA right.

But I wonder... howcome one vehicle gets all the wrong/defective parts?

Only thing I can think of is... that the parts have been replaced by the dealer for his on good ... while the vehicle was in his possession before sale.

TATA's arguements seem similar to the one they have made in Varun's case too.

Hmm....more quality problems for Tata.

You bet I have read this. You have no idea with what hunger I have been desperately searching the web, the print media, pushing my lawyers for similar cases and above all asking for help on this forum.

You sometimes get lemons rolling off the production line. Last year some local chap bought a Rolls Royce and had no shortage of problems. The car was in the dealers service department more than it was on the road.

Some one should be dare enough to do such fight to get something done. What ever it is none can replace Mr.Goyal's mental agony during the fight for justice.

I am glad justice is done. Though late, but still the right thing has been done. TATA should take these in stride and consider as learning experience. Now give the man a brand new Manza and try to impress him ;)

I am not sure why our court is not giving fine to the Manufactures in huge amount and gives 20% to the consumer and rest 80 % to the road accident victims funds.
Say they can fine Tata 20 lakhs and pay the consumer 4 lakhs and rest 16 lakhs towards that fund.By this way both the consumer will be satisfied for his long fight and funds also can be raised ,even the manufactures will not repeat this again.

i belive customer must receive more than 30K for the time he had spent running around court! any idea what exactly was the "defect"?

Will TATA also pay for other damages? Like the customer's lawyer charges, etc?

This thread is almost 4 years old, not sure why it's digged back.

My Gosh ??? How many years did it take for the court to settle this lemon case ?? It's shockingly very high. When we Indians get judgement's sooner ??

4 year old thread coming back to life now huh? Amazing! So this means 4 years to resolve the issue. And 30k is the settlement? Thats rubbish. I always thought it would be a 7 figure amount!
