The ATROCIOUS AMENDMENT of 30 days has been quashed by the Honourable High Court Of Karnataka.

In a setback to the State government, the Karnataka High Court has declared as unconstitutional the law that forced owners of vehicles registered outside Karnataka to pay lifetime tax in the State when the vehicle is used in Karnataka beyond 30 days.

In his order, Justice Anand Byrareddy has quashed the demand notices issued by the RTOs to several owners of out-of-Karnataka vehicles after seizing their vehicles, asking them to pay lifetime tax here.

Appreciate the good work, this is a boon for the migratory birds of the IT species. Has the court set up a timeline for the government to refund the tax that has been paid by the car owners and also reimburse the fines that they paid?

Pointing out that the payment of lifetime tax is always linked with the registration of vehicles, the Court said that the MV Act allows owners of vehicles, to use it in another State without re-registering for 12 months.

The question of levy of tax on vehicles under the Karnataka Motor Vehicles Taxation (KMVT) Act, 1957, the Court said, arises only when a vehicle is registered in Karnataka.

“The tax can not be levied under the KMVT Act on already registered vehicles merely on a presumption that a vehicle registered outside Karnataka has remained in Karnataka for more than 30 days,” said Justice Anand Byrareddy.
