When it comes to trademarks and company names, even similarities are not allowed, to avoid any confusion. When I applied for my company name, the first set of 3 names were rejected for having similarities with existing companies all over India. Then I proposed second set of 3 names, the last one was accepted.

Once lawyers get involved, they go after everything, throwing 100 darts hoping some of them to stick. It is basically a ploy to thicken the case file and distract the other side. You'll see this ploy whenever you read a legal document, or even a software EULA we all accept without reading.

A non legal point of view!!

Common_Man goes to buy TT innerwear.
Sees Audi showroom with TT written somewhere in the showroom.
Mistakes it for new TT Garment showroom.
Wonders why swanky Audi cars are parked inside the showroom, then decides it's none of his business!

Common_Man meets the SA:
C_M: Do you have TT underwear?
SA: Sorry sir, but we have some TT T shirts, leather bags and stuff...
C_M: Sure..! Show me...

Common_Man likes the TT Leather bag.
Asks the SA to bill it.
Very happy that TT Garment company has brought out such nice leather bags!
Common_Man sees bill.
Eyes pop out, has mild heart attack!
Curses TT Garments for the atrocious pricing compared to TT underwear.
Storms out of Audi showroom.
Swears never to buy TT underwear in his life.
Wonders again what swanky German cars are doing inside the TT showroom, but is too mad at TT Garments to keep wondering.

That, my friends, is why TT Garments is worried about Audi using the TT name!

Hilarious! But, true!!

I think TT should be applauded for standing up to a German giant.
Especially, since in India people are hadly bothered about intellecutal property, copyright etc..

Lets not get blinded by our love for Audi

TT is a publicly listed company, and before the onslaught of Jockey, and all the other copycat brands, was the only brand along with VIP in the undergarment industry. I do see the suit as frivolous and without merit though.

Nicely put

Audi may not win this case, as many have rightly put - they don't have a case within the garment industry. However, if TT sells any of their underwear with four rings (Audi's logo) - they will be in deep trouble with Audi

Well I just read the complete order today and guess what thay do have a pretty strong case. T. T. Has over 83 granted trademarks and mind you there are only 45 classes under trade mark law in India. That's like registering all categories of goods and services twice over. I won't call it a completely devoid of merit. Honestly speaking Audi called for it, they ignored to do their due diligence. Our Indian manufacturer Maruti was smart enough to avoid to rename the Splash as Ritz when they found Splash was already registered by Ford. It's another topic altogether that the Ritz never managed to make a Splash.

Also the injunction is also not specific to only certain categories of goods, but is a blanket ban on Audi from using TT in any form on any goods or services. So effectively they cannot even sell the car atleast until December

Did a small experiment :

Asked a few middle aged, splendor loving uncles of mine. Most of them had heard of TT the textiles company and hardly had a clue about Audi TT (they did know Audi as an expensive car though).

The same questions to people at work - No one had a clue of TT. Some knew about the Audi.

So, guess it depends on who you are talking to - auto enthusisat or commoner.

The Delhi HC has reportedly modified its order to exclude merchandise relating to cars from the injunction, though it remains in place for "class 18 leather goods and clothing".
