Volkswagen fined Rs. 171 crore for dieselgate

The National Green Tribunal (NGT) has said that Volkswagen should pay at least Rs. 171.34 crore in fines for damage to health caused by diesel emissions.

According to a report, Volkswagen cars released approximately 48.678 tonnes of NOx in 2016. Based on this, the NGT panel has estimated the cost of health damage using Delhi as the base city.

According to the NGT, Volkswagen recalled 3.4 lakh vehicles, out of which 2.53 lakh have been recalled. As per figures published by TERI and ARAI, 1,56,000 tonnes of NOx is emitted in Delhi. The annual average ambient NO2 concentration in 2016 was 69 µ/m3 and the change in NO2 levels due to VW vehicles was found to be 0.0215 µ/m3.

In November 2018, the NGT had directed VW to deposit Rs. 100 crore with the Central Pollution Control Board (CPCB). In the US, a Federal Judge had approved a $14.7 billion settlement in 2016.

Interestingly, at the bottom of the same source article is this concluding comment:-

Ok I know VW is wrong here but I never really understood the statement which states "Cost of damage to health", like really? I never knew you can pay off the tar accumulated in one's lungs post breathing in the polluted air so that it comes out. With my understanding, neither can money reverse the damage done in one's body nor can it fill up the hole in the ozone layer caused due to pollution. Either that or I'm missing something.

And its anyway not the situation that they are gonna distribute the money to the people of the country who have suffered from the pollution. Maybe one day this money can be used to plant more trees and towards R&D of new CFC free/ green technologies? or is it just smart play of words to fill pockets?

Perhaps this money can be used to create a charging network all along the GQ, to encourage the adoption of EVs. Hopefully that would boost/accelerate the EV revolution, and make up for some of the harm that has already been done.

National Green Tribunal (NGT) today asked Volkswagen to deposit Rs 100 crore by 5 PM tomorrow in the emission case or else face punitive action including arrest of carmaker's directors.

Jokes aside, this is so true. In other countries, the penalties imposed on VW resulted in owners getting something in return - part refund, buy back at original price, or extended warranties of 10 years etc. But in India, no one bothers about owners!

I'd go with the latter. Look at a few examples and it is easy to understand: -

1. Rohtang pass tax.
2. Nilgiris Green tax.
3. Some tax collected at the Goa border.
4. Green tax imposed on vehicles above a certain displacement.
5. Penalties asked for/collected from offending Companies like Union Carbide.

These penalties are merely meant to serve as a deterrent and of course, put some more cash into the sarkaari coffers.

NGT fines VW Rs. 500 crore for dieselgate; VW responds

According to a media report, the National Green Tribunal (NGT) has imposed a fine of Rs. 500 crore on Volkswagen for using an emission cheat device in its diesel cars. It has ordered the company to deposit the amount within 2 months.

In November 2018, Volkswagen was directed to deposit a sum of Rs. 100 crore with the Central Pollution Control Board (CPCB) and in January 2019, a joint team of officials from CPCB, Ministry of Heavy Industries, Automotive Research Association of India (ARAI) and National Environmental Engineering Research Institute had recommended a fine of Rs. 171.34 crore for health damages for causing air pollution in Delhi.

In response to the NGT order, Volkswagen has said that its vehicles were compliant with emission norms defined in India and that the company would challenge the decision before the Supreme Court.

In that case why was a recall issued? Either we're missing something or Volkswagen is trying to eyewash. Now that it has gone to Supreme court, I'm pretty sure this case will stay on for years.

So basically our laws and emission norms are so weak that it allows a car maker to sell whatever they want and then point to the law and say it's optional. Great.

I drive the 1.6 Vento TDI. Love the car, love the torque and it's the 6th year with the gem. No problems whatsoever other than the usual wear and tear and one fuel pump issue. I refused to install the corrective device for the emissions on the car. In principle, why should I have a lesser experience if the car manufacturer is at fault?

I hope we get some resolution from VW directly to the owners. And I also hope that our authorities fix these type of "optional" laws and norms.

We won't. The firmware kludge will be pointed to as problem dealt with. With a free box of chocolates

This has cost them so many billions, in assorted currencies, that even giving us all new cars would be a small marginal expense. But hey, what would that car be? The same thing with the software kludge, I suppose!

Does that mean, if I steal a car, use it for a year, and voluntarily return it, then I am no longer liable for criminal proceedings?
