300 workers go on strike at Tata's Sanand factory

Since February 22, 2016, nearly 300 workers at Tata Motors plant at Sanand (Gujarat) plant have gone on an illegal sit-in strike, demanding reinstatement of 20 workers. These workers had been suspended for serious misconduct.

The upcoming Tata Tiago (earlier known as Zica) will be produced at the Sanand plant alongside the Nano. Its launch is scheduled in a few weeks and currently, talks between the management and workmen to resume operations are in progress.

Earlier this month, the Tata Marcopolo Motors plant at Dharwad (Karnataka) witnessed a strike by workers demanding higher wages forcing the company to declare a lockout on February 6.

Who decides whether a strike is legal or illegal by the way? Paid media does their job very well

All the recruits are hardly 4-5 year old fresh ITI pass outs.
I don't think they can have any Union unless they complete minimum 5 years of Employment.
Further, there were a lot of those members who quit their jobs since other OEM's started their manufacturing there.

Any updates on the 'misconduct' details of those 20 people who were removed...?

Assuming that TATA would have already produced at least 5-8k cars (With Zica Name) before the name change process, this might not affect immediately. But yes, yet another cause of concern for them.

The Striking workforce damaged around 50 cars inside the plant's premises. This clearly shows workers' commitment and job ownership level. It also shows the absence of worker's leader with effective negotiation skills. So, in order to put forward and speed up the negotiation proceedings, they vandalized 50 copies of Nano. Very poor show of threatening company's management.

The various provisions in Industrial Disputes Act decides whether a strike or a lockout is a legal one or illegal. But I wonder whether the media would have given any thought about those sections before terming it illegal.

Rediff website reports:

The conflict began around Diwali when a group of workers demanded pay hike so that they could be exempted from the Employee State Insurance deductions. The average worker’s salary at the plant around Diwali was Rs 13,000-13,500 per month. If this amount was raised to Rs 5,000 per month, they would be exempted from ESI deductions. Workers actually preferred the company-run health scheme over the ESI scheme.

The company was said to have agreed in-principle to implement the wage hike. However, two workers were suspended by the company for agitating. Recently, after an enquiry, the management decided not to take these workers back. This is when the remaining workers protested, demanding re-instatement of the sacked employees. On 22 Feb, action was taken against 26 workers when they allegedly incited other workers and damaged some property.

I think TATA should not yield to such pressure tactics. This will inspire hooligans to think from a very "mean" angle of protest, every time they want a negotiation.

Even if TATA agrees to re-instate these guys, they should heavily penalize those who were involved in the vandalism with a cap on their growth within the company, fully agreed by these people & labor laws. High handedness has become the style of living & getting things done these days; these people need to be termed criminals and not workers.
