Re: 1% TCS on vehicles above Rs. 10 lakh from June 1, 2016

I spoke to a friend who is in this profession. The dealer cannot file for amendment and nor can he show as receipt from another person as previously mentioned by me. As this will be considered wrong per IT. It’s like as if someone else is making payments on someone’s behalf.

The only option with you is to get it adjusted or returned during filing of your annual return. Do keep a certificate from the dealer should it not reflect in your account.

Re: 1% TCS on vehicles above Rs. 10 lakh from June 1, 2016

I have a particular problem. I'd purchased a car in Oct 2022, and paid TCS of 14k.

I can see it reflected in my Form 26AS, but under Section 206CE, with description "Collection at source from any scrap", instead of 206CL "Collection at source on sale of Motor vehicle".

AIS also reflects TCS on "Purchase of scrap" and not purchase of vehicle.

Will this mismatch in description be an issue when filing ITR? Should I contact the dealer to get it corrected?

Yes please. Why run the risk of a clear dealer error? Write to them formally and politely ask for it to be corrected ASAP. Escalate if required.

Re: 1% TCS on vehicles above Rs. 10 lakh from June 1, 2016

I purchased my car last July (2022) and in constant follow up with my dealer for receipt of TCS deposit for my car purchase. To date, I have no updates and do not see the TCS entry in AIS or 26AS.

What are my next options if dealer failed to report my TCS for F.Y2022-23 until date?

Hope all followups were in email, to official email address (not Gmail or something).

If still no response, escalate to car mfr (again, on email; always leave a paper/electronic trail).

Which car? Which dealership?

Agree! Escalate formally quoting all relevant information to dealer principals followed by OEM and then IT Grievance or PG portals (https://pgportal.gov.in/)

Re: 1% TCS on vehicles above Rs. 10 lakh from June 1, 2016

Friends I have a query regarding the 1 % TCS
I am individual owner of a 4 wheeler & is selling the vehicle for a value of Rs.1185000
The purchaser is also a individual owner
Is TCS @ 1% applicable here for a second hand car ?
Should I collect this from the buyer & deposit it ?
I presume GST on second hand car is not applicable here as it is sold & bought by individuals
Appreciate your quick inputs here
