After forcing carmaker Maruti to stop using contents of a survey that showed it in poor light for print advertisements, Hyundai Motors India Ltd has moved MRTPC seeking to stop its rival from using the same study in posters and pamphlets.
Hyundai Motors India Ltd (HMIL) has sought to amend its original petition filed before the Monopolies and Restrictive Trade Practices Commission to include posters and pamphlets in the purview of its prayer.

The Commission had in August directed Maurti Udyog Ltd (MUL), India's largest car manufacturer, from using the findings of a disputed TNS/TSC study in newspaper advertisements.

During the proceedings last week, HMIL alleged that Maruti was still using the contents of the TNS/TSC study, but through publicity bills to woo potential Hyundai customers and argued that this practice was unfair.

MUL is distributing pamphlets and posters to its dealers and distributors for circulation among our potential customers, HMIL alleged.

MUL, which submitted that it had stopped using findings of the survey in print advertisements since August 31, however, argued that there was no bar on using the same in posters or publicity hand-outs.

HMIL had not mentioned about pamphlets and posters in its petition filed in August, the counsel for MUL contended.

Replying to this, HMIL's counsel said that at the time of filing of the petition, his client was not aware of such practices (pamphlets/posters) and sought to amend the petition.

Accepting the argument, the MRTPC Bench comprising MMK Sardana and DC Gupta directed HMIL to file the amendment petition within two weeks.

The Commission also directed MUL to file their reply in two weeks after HMIL files the amendment petition and listed the matter in the first week of January for next hearing.

Earlier on October 12, MRTPC had advised MUL and HMIL not to target each other in advertisements and asked MUL to file its reply on whether it had discontinued the advertisement.

MRTPC is hearing Hyundai's petition, which says its products were shown in poor light in campaigns of MUL which came out in the media in August.

The advertisement in question had drawn comparisons between cars manufactured by Maruti and those of competitors, including Hyundai, on various parameters like resale value and mileage.

Hyundai had alleged that MUL's advertisement was a fit case of "unfair trade practice" and was intended only to mislead the consumers.



Now, has not Hyundai done this in the past? How can they accuse maruti of misleading the customers. They had compared Accent with Fiesta only based on Engine power. What happened to other parameters? Is this is a fair practice?

Whats wrong in using plain statistics in an advertisement? Maruti has merely used numbers from external and established sources. Sure, they used selective data to suit their purpose. Hyundai...well....just got a taste of their own medicine.

Hyundai was the master of this game...

Their was this autocar india shootout where they said Santro has .2 or .5 city mileage more, while wagonR has .2 or .5 highway mileage more...

The Snatro as used to show this figure for a few months.. But... Only... Santro has more mileage that wagonR... Autocarindia

Hyundai also have compared accent with fiesta based only on HP in several ads.. Also...

Tata gives ads comparing Indica and alto based on power only...

Donno why Hyundai is suddenly complaining??? Cause all their models are failing??? elantra, Getz, Sonata Embera... Now, even the Verna, with its superb CRDi hasnt made the impact like the Fiesta did...

Coming to think of it, with Santro out of the equation... Hyundai would really have a hard time in India...

All manufacturers rely on statistics to prove that their products are superior to others. That does not mean their products are not selling properly or they are having hard time in India. Both Maruti and Hyundai have resorted to doing these types of comparisions, because they have products in the same category.
You have quoted that Tata also does this comparision for Indica, does that mean Indica is failing???????

Case of the egg coming before the chicken - in this case in front of Hyundai's face.

Am not saying that since they resort to statistics.. the product is failing...

I am saying that.... Hyundai is struggling a bit now... Elantra flopped, Getz couldnt help them, Sonata Emberra bombed, and now, even the VErna with its superb CRDi hasnt made the impact that fiesta did...

Am saying... If santro sales come down suddenly, cause of any new model in the market... Hyundai is going to have a hard time...

Does anyone remember the Scorpio being compared with the ESteem, Corsa, Ikon and Accent ??

I get a feeling that some people who may be against Hyundai, use this forum to give them a bad image. As you can see, there is another thread also trying to "reveal" the "atrocious" situation in Hyundai plant. We dont know the truth about these things, may be only Hyndai makes mistakes in this perfect world.

Without the santro... I guess hyundai would be out of the game
None of their cars have performed well...They are offernig a 2L discount on Embera for God's sake... i would love to see another company do the same with their flagship model...reminds me of the Daewoo era...

I would compare hyundai to a small kid. whenever his turn comes in Hide'n'seek he starts crying 'unfair' running in his mommy's lap. :D
