Bombay High Court removes restriction on sale of Biodiesel
The Bombay High Court has relieved the restriction on the sale of Biodiesel as a transport fuel. With this ruling, bio-fuel manufacturers will now be able to directly sell as long as they meet the required quality standards.
The Motor Spirit High-Speed Diesel control order of 2005 prevented bio-fuel manufacturers from selling the fuel for transportation. Companies had to acquire marketing rights from the Ministry, which required them to invest Rs. 2,000 crore in exploration, production, refining, pipelines or terminals.
The High Court has said that biodiesel does not fall within the definition of 'petroleum' or 'petroleum products' and does not attract the provisions of Petroleum Rules, 2002. The court also noted that biodiesel does not come under the Essential Commodities Act.

Interesting verdict, does that also enable them to come under different (hopefully lower) tax brackets ?
