Second, obviously.

The RC transfer process remains the same. The heir will be recorded as the second owner.

My Dad passed away a month back leaving his car behind. I need to know the following -

1) Can I use it as it is without transferring on Mom's name ?
2) Is there any legal hassle in case of an accident ?
3) What happens if there is a insurance claim ?
4) Should I renew the insurance as it is ?

Once the owner has passed away, the insurance ceases to exist after 90 days. You need to transfer the car to your mom or yourself.

The process is easy to transfer to your mom.

Yes you do. Once you do the transfer to your mom you need to renew the insurance under your mom as well. The old insurance will be valid only for 90 days.

Need some information that is not covered here:
My father passed away 2-½ years ago, and unfortunately we have been dragged through a lot of paperwork, and will just be getting the legal heirship documents shortly.
We want to sell the car that is registered in his name. The car is registered in Pune (MH-14) and I want to take it there to sell. It is a second owner car on paper.

When I approached some people to sell the vehicle, they told me that I need to first transfer the vehicle RC to my name or my mother's name. And then while selling it, it will loose further value because the RC will show me as third owner.
Now I am not sure what to do.

Is there a way that I can directly transfer the RC to the new owner?
I desperately need to sell the car, and to sell it quickly, for the cash.
Any help; guidance; prospective agents who can help get this done; are all welcome.
Please help.

I too was in exact same situation last year.

We were planning on selling my dad's Eeco around 2.5 years after his death. The process you mentioned is the correct one. Transfer it to one of the legal heirs and then sell to another individual. Yes, the RC will show one additional owner.

The Maruti Truevalue person whom we had interacted that time mentioned that it was possible to get the transfer done without changing RC to any family member if one produces legal heir document, death certificate and a notarized letter signed by all legal heirs together.

However, later he backed off from that saying that was not possible.

There is no other way. You'll have to transfer ownership to a legal heir. And since it's 2.5 years already, you'll have to pay a penalty. It was Rs 100 per month of delay in delhi when I got it done for my dad's car.

The RC will mention the heir as second owner. So the potential buyer will be the third. You can explain the situation to the actual buyer, that the car was in the family etc, and maybe you'll get a decent price.

Bumping this old thread.

My father-in-law passed away a month ago. Unfortunately the transfer is going to take time due to covid related delays at government offices.
Even worse, the insurance is going to expire in a couple of days. Is there a way to renew the insurance or this can be done only post transfer of the vehicle to the legal heir?

The Indian government, in view of the ongoing pandemic has decided to extend the validity of motor vehicle documents like driving licence (DL), registration certificate (RC) and even permits till 30 June, 2021.

But from my experience, things don't always work seamlessly and the RTO may not be easy to manouver around after the current expiry of the insurance, so they'll need some prodding.

Renewing the insurance is possible. As in my case, since I was getting the ownership transferred after almost a year, I'd already got the insurance renewed in my name when I'd gone to submit the documents at the RTO. All they need is a valid insurance document.

Many years ago I transferred my fathers cars (two) to me. My father had a will. So it was very simple. Took a little time and some 'baksheesh'. I do not recall any issues.

This is good initiative to reduce hassle of ownership transfer in such scenarios.
The process to update nominee should be made available online for existing vehicles.

I also searched for it online, could not find. Online nomination isn't available yet for existing vehicles.
