I wont be the judge, but it was good to hear the turn of events from Ghosn's perspective, including the escape.

Nissan Found Guilty, Fined $1.7 Million Over Ghosn Income Scandal.

The company will not appeal the judgment.

Nissan has received a guilty judgment from the Tokyo District Court this week. This is in line with the scandal involving former chairman Carlo Ghosn and board member Greg Kelly a few years ago.

Nissan reported a misconduct led by its former chairman and others in September 2019. An internal investigation was conducted by Nissan and external lawyers, which found that Carlos Ghosn and Greg Kelly collaborated to underreport Ghosn's compensation in Nissan's annual securities reports.

Based on these findings, the Japanese Financial Services Agency imposed an administrative monetary penalty on the company on February 27, 2020, due to material misstatements in past annual securities reports. These acts were a violation of the Financial Instruments and Exchange Act (FIEA), which Nissan contended to be indisputable.

That said, Nissan received a guilty judgment dated March 3, 2022 and was ordered a penalty of 200 million yen or $1.7 million in today's exchange rates. After careful consideration of the principal penalty and the findings in the judgment.

Nissan has decided it will not appeal. The company also said that it has been undertaking steps to strengthen its governance and reform its corporate culture, to prevent such misconduct.

I just checked, and its still available here in Australia. Looks like it is location bound, as i remember a fellow mod was unable to watch this in the US.

Swiss court rejects appeal to withhold information relating to Ghosn investigation.

The Federal Criminal Court of Switzerland Friday rejected an appeal by an unnamed Arab businessman to stop Japanese prosecutors from acquiring access to his bank accounts.

The Japanese authorities are conducting a criminal investigation into violations of the Companies Act and Financial Instruments and Exchange Act by Carlos Ghosn, the former CEO and Chairman of Nissan. It was alleged that Ghosn used his position to obtain illicit
personal financial benefit and had transferred some his gains to the accounts held by the Arab businessman.

The businessman contested that the request should be denied since the detention of Ghosn in Japan stands in contravention of article 2 of the Act. Specific reference was made to articles 5 and 6 of the European Convention on Human Rights, as well as articles 9 and 14 of International Covenant on Civil and Political Rights. The court rejected this argument, stating that settled case law clearly showed how the protection under article 2 cannot be claimed for a third party.

The court rejected the appeal for being unfounded on all grounds and allowed the documents to be given to the Japanese authorities.

France issues international arrest warrant against Carlos Ghosn

France has issued an international arrest warrant against ex-Nissan CEO, Carlos Ghosn.



According to media reports, the French prosecutors have issued a warrant over 15 million euros in potential suspect payments. Prosecutors allege that Ghosn funnelled funds from Renault through Suhail Bahwan Automobiles in Oman and used the money for personal purchases.

The investigating magistrate in France has now reportedly issued five international arrest warrants against Ghosn and four others.

Carlos Ghosn was first arrested in 2018 for allegedly under-reporting his pay package for five years. Ghosn also faced charges of financial misconduct when he fled Japan in 2019. The former head of Nissan and the Renault-Nissan Alliance is now in Lebanon, awaiting trial. However, Carlos Ghosn has denied any wrongdoing.

The lawsuit is seeking $588 million in lost compensation and costs, as well as $500 million in punitive measures.

Disgraced former Nissan CEO has accused Nissan of defamation and fabricating evidence in suit filed in Lebanon

The one-time golden boy of the car industry is still wanted over criminal charges in Japan, where Nissan has also filed a civil suit seeking damages. But in a Lebanese court this summer it was Ghosn doing the accusing and asking for compensation.

The lawsuit also makes claims against at least a dozen people, including:

-Hari Nada, a Nissan employee seen as one of the key instigators of the plot to oust Ghosn
-Hidetoshi Imazu and Hitoshi Kawaguchi, two senior Nissan managers with early involvement in Nissan’s actions against Ghosn
-Toshiaki Onuma, a manager in the CEO’s office, who along with Nada, agreed to cooperate with Japanese prosecutors to avoid prosecution
-Masakazu Toyoda and Motoo Nagai, two Nissan board members

Just watched this, doesn't merit 4 episodes where they only concentrated more on how he escaped and no focus on whether the financial misconduct happened or not.

but got to know little about Japanese law system, it's not fair certainly.

also I guess he probably did the right thing considering how it was a coup by the company to oust him. not worth giving up the life rotting in a prison whose justice systems aren't fair as it appears.

Even if financial misconduct happens, the treatment meted out wasn't proportionate, my these comments are in that light

Only hope those huge musical boxes, (he was hiding in one) loaded in a private airliner are displayed at a Carlos Ghosn museum in Lebanon sometime in the distant future, whenever his well wishers feel that the time is right.

Lebanese court orders home eviction of former Nissan boss Carlos Ghosn.

A Lebanese court has ordered Carlos Ghosn – the former CEO of Nissan and Renault – to vacate the Beirut house he has lived in since fleeing Japan in a large box almost four years ago.

The home with pink walls in the Lebanese capital's upscale Ashrafieh neighborhood is worth some $19 million and is registered to Lebanese company Phoinos Investment.

Phoinos initiated the legal action in 2019 and has accused Ghosn of "trespassing on private property and living in the home without legal basis.

Ghosn said the company was affiliated with Nissan and that "the property was purchased ... for his residence, and there is a signed agreement with Nissan that grants him the right to reside" there.
