In Europe drivers are given a 10% discretion over the speed limit. The same should be applied here. In my opinion the 10% is not unreasonable - It accommodates for a variety of scenarios.

Simple speedguns with Camera, and you cannot argue if you're above the limit, there is no % error concept being entertained.
