Copyright infringement

I want to draw your attention to this site - Picasa Web Albums - Vibin - Wildlife#

To me it appears that some of these pictures are stolen from the pictures taken by Dr. Abheek & Fazal

He has already stolen my friend Sankar Sridhar pictures of the Chadar Trek in Leh and posted as his. Picasa Web Albums - Vibin - CHADAR TREK#

This is just to bring to notice.

is the said person selling the photographs or using them in any other manner commercially?

Action can only be taken in that case.

Copyright infringement is illegal whether or not person is selling the pics or not.

Don't know. At the moment these photos are on his Picasa site.

He is claiming them as his own which is an intellectual property right violation
he has the copyright mark...stating they are his

Just curious, where does he claim explicitly that the photos are his ?

Any content is copyrighted the moment it is created. Action can be taken even if the infringer is not making money off it. It the infringer is making money off it, the said person can be sued for statutory damages. Try sending a cease and desist order. If the person does not respond favorably, send one to Picasa telling them about the stolen content.

I suggest you meet a cyber lawyer and contact Picasa through him so as to track his IP Address. If you contact him directly, there is always a possibility that he will remove from that album but create an account somewhere else and upload the same photos.

On the right-hand tab you can see "Photo reuse" which states "All rights reserved" which states his claim.

Sridhar's book (Ladakh Trance Himalaya) publisher's lawyer is already at the job. Vibin is not answering his phones or responding to the several emails sent.

It's better to watermark the pictures avoid such situations.

A small text in bottom right should have been fine.

Does that mean that He is reserving those rights for himself? I think the notice comes with using picasa.

IANAL, but Doesnt it just mean that the Copyright holder reserves the rights. He does not specifically state that he is the copyright owner, nor do i think that it is implied. If i were to create a picasa account and upload those pics, the same notice would be displayed.


How were the original images licensed ?

I am wondering if I can ask this here, maybe someone can give an opinion.
I own a lot of old photos which I have actually purchased, many have been put up in the Nostalgic thread of the vintage car section. What about the copyright of these pictures? I never claim a copyright because I do not know from where and how these pictures were sold on, and I do not know the rules applicable. I have traced some former owners of the photos purchased from others, I never discussed ownership of the prints, and sometimes made and gave them copies. Instead of mentioning a copyright, I just mention "my collection".
In some cases I even aquired the negatives. And I am clear that I never took these pictures.
So where do I stand? Opinions are most welcome.

When you upload photos on Picasa, you have to choose a license for them. If you choose something liberal like one of the Creative Commons licenses, others have a right to redistribute your work.

What I understand from your statement is that if I upload my pictures on Picasa, I've to choose licence that shall limit or delimit the distribution. Right?

What if the uploaded pictures themselves are stolen/usurped?

My doubt was, what were the terms & conditions imposed when/where these pictures were originally uploaded ( and from where this guy has taken these from) .
