re: Overdrive Magazine plagiarizes my Travelogue (now resolved!)

To the OP:
Is it ok for us to go ahead and inform everyone via social media of this?
I believe you were in the process of deciding some course of action against overdrive.

re: Overdrive Magazine plagiarizes my Travelogue (now resolved!)

Sad, shocking and shameful. More and more people are resorting to such easy ways to publish content by copying it from somewhere.

Tanvir, since this is a print media where they have errer, I believe u have a stronger case. There have been incidents where people have been given compensation in such a case. I stringly suggest you to not let these guys go scot free.

re: Overdrive Magazine plagiarizes my Travelogue (now resolved!)

Hi Tanveer,

I read your travelogues, they are great and not only that they are inspiring enough to motivate others to at least try something similar on their own.

Sad but not surprised to see other commercialized magazines copying your t`logues w/o your permission to sell their magazines, this is not unique and again this is not the last incident that these bunch of inefficient and ineligible guys would do this!

Please do not leave them just like this..., I`m not a legal expert, but from an ardent follower of your threads can suggest you - NOT TO LEAVE THESE GUYS! TAKE SOME LEGAL ACTIONS, so that they think twice before CHEATING their readership!

Team-BHP is unique and you guys are "special", in todays world there are very few examples of honesty and non-commercialism, and each and every member associated with this forum deserve respect that they share their experience (small or big) for free.

Please take legal actions, OD is a big CHEAT !

All the best and do not stop sharing your T`logues to thousands of others just bcoz of a small bunch of cheats!

I would suggest to write a mail to overdrive with cc to Network 18. If you do not get a formal and encouraging response, find a lawyer here is what got from TV 18 website

Film City
Noida, Uttar Pradesh 201301
Phone: + 91 120 4341818
Fax: +91 11 66173955
Email:complaint@network18online.com

However, before making a complaint viewers are encouraged to go through the Code of Ethics & Broadcasting Standards, News Broadcasting Standards (Disputes Redressal) Regulations and Guide to the Complaints Process. These details are available on the website of NBA www.nbanewdelhi.com

This suggestion makes eminent sense. This case prima facie involves two violations one that of copyright laws and two that of cyber piracy since the content was published on a website from where it was plagiarised.

If the demand from you is just for a retraction or appropriate credit they will gladly publish it in a forthcoming issue in a manner in which they will not be liable for any transgressions of any statutes .

If on the other hand you demand adequate compensation they WILL if I am not mistaken try to browbeat you into submission by throwing their corporate weight. If you do choose to pick up the gauntlet you have a tough fight ahead of you.

Since OD claims that a person masquerading under your name sent in the article to them, a criminal complaint should be filed for impersonation against OD and persons unknown. It is my experience that when organisations see a dispute which can be tried under laws pertaining to civil disputes they are very nonchalant and dismissive about the matter. However when the issue takes on overtones of violations of statutes resulting in criminal prosecutions their tone changes. The key here is for you to establish OD was complicit in this impersonation of you. I suggest you talk to a lawyer working on the criminal side with a focus on cyber crimes.

All the best in fighting the fight.

ps: If I am not mistaken you are an IT professional. So tracking IP addresses should not be a big deal for you. So if they do claim the article was sent to them via email it will not be a big deal in finding the so called submitter. If they claim the article was sent to them in hard copy form they will have to provide credible proof that you sent it to them. All in all I am guessing these jokers have buggered up big time. You have caught them with their hand in proverbial cookie jar so to speak. Make them pay.

re: Overdrive Magazine plagiarizes my Travelogue (now resolved!)

tsk1979: First of all sorry for doubting your thread since it started on 1st April. But having read the magazine I am appalled. Some serious action needs to be taken by you and the community here.

@Mods: I am sure Sirish or some one else can be contacted for their side of story and published here. Not that it matters but will go a long way in showing that we are not biased and at the same time leave no room for OD to play. Given the circumstances they can, to my mind, have no recourse but own up and say sorry.

@SirAlec : That link goes back to OD facebook page. But nothing there about this thread. Censorship? Should all of us link this thread on OD facebook page?

re: Overdrive Magazine plagiarizes my Travelogue (now resolved!)

I believe they are working overtime to keep the Face Book page clean.
Nothing much is found there.

What and how is OD as a magazine isn't relevant (here), but the fact that they printed Tanveer's log w/o permission is simply not done and is unethical.
Waiting for OD's response.

re: Overdrive Magazine plagiarizes my Travelogue (now resolved!)

I helped a friend get a decent compensation for Spectacular Start-Commonwealth games 2010 | Flickr - Photo Sharing! image which was used by the CWG OC's media agency. Courtesy the immediate nature of the event & some strong twitter anti-publicity, he was compensated in 4 days flat. Your case is not as straightforward. Let's hope for the best!

re: Overdrive Magazine plagiarizes my Travelogue (now resolved!)

Thanks everyone!
There are two issues here
1. Lifting of traveogue and pictures and using it commercially.
2. Using me as a brand ambassador for Goodyear tires without my consent
I will not give up even if they try to browbeat me.

re: Overdrive Magazine plagiarizes my Travelogue (now resolved!)

go after them. don't just send notices but also make this known in as many public fora as possible so their readers know what the magazine is up to. online media is super in that respect. this thread should also be kept on the TBHP home page for a while so readers know.

the auto enthusiast community is active enough on not just print media but also online media like BHP.

baring the facts all over the place should only cause the right kind of embarrasment for the magazine.
