re: Overdrive Magazine plagiarizes my Travelogue (now resolved!)

Those lamers have even removed me from the Overdrive community on Facebook because I kept posting about this issue there. Now I can't join back and even when I try to "Like" their page, I can't see comment on their wall or discussions page. What a bunch of jerks. I so want to kick them in their nuts.

re: Overdrive Magazine plagiarizes my Travelogue (now resolved!)

TSK,

I'm a student of Law and from what I know, you're entitled to catch them by the scruff of their neck and drag them to court.

Follow this procedure:
  • Take a print out of this thread and your travelogue. make sure the date of posting the travelogue is in view.
  • Make sure you copy the page onto a pen-drive and keep a soft copy of the same.
  • Make a list of the facts in chronological order. i.e. from the date of posting, to the date you found out about this. Make sure you don't leave out a single detail.
  • Go to the news stand and pick up the issue and keep it for reference and validation.
  • Make a file of all the necessary print-outs and documents and approach and engage a lawyer who specializes in IPR.
Do not:
  • Send them an email or get in contact with them in any way. They can use it against you, stating that you were in contact with them before the suit was filed.
  • Give them any space to breathe. The moment you do that, they will take advantage of it and not let it go. For eg. they will suggest various things like a pittance for the article, or perhaps brush it off completely saying that you've 'gained' fame due to their publication. They might even claim that they sent you a notice via email and you did not reply so they published it anyway.
  • Since they've mentioned your name, they will claim that they have given you due credit and if you push things further, they will offer to post an apology in their next issue for the wrong statements such as the use of Goodyear tyres. Do not accept this.

re: Overdrive Magazine plagiarizes my Travelogue (now resolved!)

This is really shocking. Seems like a hurried job of a journo. I have little knowledge of these things, these things are called as advtorial (advertisement + editorial). Usually the copy is checked by the company before its ok'ed for publication. But sometimes they do not have the time to check the same and the publication will do ahead and print anything they want.

If you really get to their collars, expect finger pointing between OD and Goodyear.

But you really have a strong case here, you should not let them get away with this.

This is bad. Purely commercial. They have made a false claim by this and that too stealing the facts from owner.

Really wondering, if they are so much running out of contents, that they take from other forums to publish?

Tanveer, on a lighter note, you just became a celeb next to Poonam.

Print media has often published articles lifted from web, as well as pictures lifted from photo sharing sites.
However, using somebody's name for endorsement without permission, thats a first.

Hi Tanveer,
You might want to remove comments regarding what course of action would be preferable to you.
I am sure OD must be keeping tabs on this thread.

Edit: change that to what you are being advised.
Mea culpa, if any.

re: Overdrive Magazine plagiarizes my Travelogue (now resolved!)

@Tanveer

I being a OD subscriber feel really sad to see such an incident happen. I never expected this from OD. Recently however, I was thinking of canceling my subscription. And now this! Nevertheless, I have decided not to renew it, Ever!

That being said my heart goes out to you. I read your Travelogue and i saw the sheer effort you put in penning it down. It hurts to see your hard work stolen.

I am disgusted by OD! Dont let them get away for this, All the best to you for this case!

Here is a pic that i took; It is from the index of the April issue. It says that you are a reader of OD:

What a shocker. Didn't know that respectable (ahem!) magazines did this.
