Isnt your insurance supposed to pay this out as 3rd party? Dont act tensed, be calm and reject everything if he tries to bully you into paying.Tell him to go ahead with the FIR.

@Deepak, hope you have some evidence to support yourself - apart from any bank statements showing a payment to him.

Hopefully, the worst is over.

I've already paid him. The decision was more out of being bothered about the matter too much.
I've a very bitter experience of running to court for three years because of a very similar silly accident in 2005. I don't want to ever step into court again.

Isn't a bank transaction good enough? Payment was done by an A/C payee cheque.

Might have been heavy on pocket, but sometimes peace of mind is more necessary than running around.

answers to your questions
1. can he file fir now: FIR is filed by police- yes he can file a case now.
2.fir goes to court, court will issue you a summons - drama starts. he will not come to court, you will keep visiting .
advise:
1. since you have already siad that you will manage the repair part- nothing much you can do.
2. compromise, plead some how and pay off whatever you can.
going thro court, you will spend more and imagine opportunity cost.

Dear Five46, My sympathies with you. But all is good that ends well. Peace of mind is a better bet in any case even when you had to pay a decent sum for no fault of yours. But look at the positive side. No injuries to anyone involved. Life is like that. Move ahead.
