Supreme Court stops e-rickshaw registration

Kanishk Sinha, whose company Jasper Motors holds a patent for “battery mounted on a vehicle which is eco-friendly and is restricted to e-rickshaws,” claimed that he is the only facilitator who can get electric vehicles registered in the country.

The Supreme Court of India has ordered all state governments and union territories to stop the registration of electric vehicles.

The order comes after Kolkata based lawyer Kanishk Sinha, whose company Jasper Motors holds a patent for “battery mounted on a vehicle which is eco-friendly and is restricted to e-rickshaws,” claimed that he is the only facilitator who can get electric vehicles registered in the country. He argued that no state or union territory had the right to register any electric vehicle powered by batteries.

It is said that to register an EV, customers will have to use the services of Amit Engineering as it has leased the rights from Kanshisk Sinha. The court observed that EV registration by any other entity would be an infringement of the patent.

The apex court had passed an order to stop EV registration on February 24, 2020. This order was upheld on January 12, 2021, following which, the Delhi government said that it will stop the registration of e-rickshaws.
