Expired RC in a different town. Safe exchange possible?

My dad's M800 RC expired a few months before Covid19 hit. The car is registered in an RTO that's about 250KM from where we live now.

Renewing the RC requires driving down the car over for inspection, which frankly we don't want to do since we're looking to upgrade the beater.

Plus, we've gone light on the maintenance due to covid19 and we'd rather not spend on service right before selling it. It does require a service for a 500KM drive.

Finally, renewing the RC would involve paying penalties as well.

Coming to the questions/options:
  • Can we exchange this car at a dealer (likely MS or Hyundai) without worrying about when and how the M800 car ownership is transferred? Given that the dealer would issue a receipt about the sale/exchange.
  • Or should we clear all the RC pariculars before approaching a dealer?
  • Or clear all RC particulars and sell off the car to an individual buyer before approaching a dealer?

Primary concern is car misuse while on our name, and possible higher tax in Telangana due to owning multiple cars. I've previously always sold my vehicles to an individual buyer and transferred the RC, so this is new for me.

In case it has expired after 1st February 2020, the RC will be valid till 31st December 2020 as advised by the MoRTH.

My suggestions/ observations :

1. Get a backlog entry of the RC done in the Parivahan portal. This should ideally be done in the same RTO that the car was last registered in.

2. Approach the current RTO with proof of current address under their jurisdiction and ask for the way forward.

3. Pay the penalty and get the records straight before selling the car to an individual.

4. With a dealer exchange, you run a risk until the car is transferred to a new buyer.

I noticed this as well. However, our car's registration expired well before Feb 2020.

Unfortunately, our vehicle doesn't even show on Parivahan, citing "Registration Number is not available in Vahan4 database, Please contact the concern RTO".

We already contacted our local RTO and they wouldn't do anything with the registration unless we brought an NOC / CC from the original RTO.

Looks like our only bet is to drive down to the RTO, set things straight, and then decide the way forward.

It appears that due to some confusion, our Maruti800 was unregistered since 2015 and my dad had never realized it. Can't be mad at him because he's over 65 and wasn't in town either.

Nevertheless, an agent said that the RTO wants to charge 500/rs per month for 5 years, not including registration fees, taking the amount to around 40K+. The car itself would fetch no more than that.

Can someone please let me know if there's a cap on the penalty or if there's a way to make an official plea to have it reduced on account of his age?

Unfortunately there is no cap in the penalty. You or the buyer have to pay 500 rupees per month penalty. While selling my car I had to reduce some 20K because of this. Sooner you renew the better.

I doubt any RTO will be willing to subvert this process by reducing the penalty, especially in these Covid times when govt treasuries are empty.

I really want to ensure a clean cutover to avoid #1.

Would you know what the process is to scrap a car officially? An RTO letter would help assuage our psychological fears even if the scrap yard decides to end up using it without scrapping it.

SCRAP IT. If RC has expired in Late 2019 or Early 2020 then she is already 16Y+ now. You can get the car scrapped in front of you where they cut the car in your presence.

An update: We drove the car to the remote RTO, paid the hefty penalty of 26K, and renewed the registration. When you book a slot the website lists the cost involved and you can pay it rofht away online or via MeeSeva within 24 hours.

Yes, lot of expense but there didn't seem to reliable scrappers that could guarantee that the car wouldn't be used and would help cancel the car's registration. The lack of procedures in place to make this happen are disappointing in a country as big as ours.

We've now put the car up for sale. If that fails, TruValue to the rescue.

I have a similar problem with my bike. Bike's registration expired in Aug 2020, now wanted to know what are my options. Bike is in good shape, except the RC & PUC which is now expired. Insurance is valid till 2022 January.

My plan is to buy a new bike. My heart want to buy RE Meteor and head tells me to buy Yamaha FZ-S. This is a matter of different debate thread, however. In this case, what are my options? May I request expert advise on this? Thanks a lot in advance.
