ASCI Asks Nissan To Modify Or Withdraw Magnite Advertisement

Source

Interesting to read that Nissan has used data from tbhp to derive their "Best-in-class" claims.

Quote:

ASCI Secretariat claimed that the response is inadequate and has requested the advertiser to provide verifiable third party comparative data to show that they were the ‘Best-in-class’ among their competitors. Nissan responded by saying that the comparison was done based on the declarations made by the respective manufacturers/OEMs. The advertiser had taken the data from auto portals like TeamBHP which are independent third parties, for claims whose details were not available on their competitor’s website or their social media platform.

Didn't see ASCI reacting when Skoda Superb launched its "Best in Next Class" campaign- some influential competitor must be facing the heat from the Magnite.

Pretty evident some of the bigger (by Indian footprint standards) manufacturers feel threatened by the Magnite. This in itself proves what a stellar offering this is in the segment. Even the YouTube reviews were supremely biased trying to put down the Magnite with jargons like low-cost-engineering , competitor to smaller hatchbacks, below the sub4m CSUV segment :coldsweat

Well done Nissan. Make sure the dealership and A.S.S experience is as good as the offering and you are in here for a long haulclap:

Interesting to see the political move from the competitor giants :Frustrati

So Nissan India has shaken someone's table it seems.

Thanks for sharing, five46! Long time since we heard of such a case, so I think it's worth an independent discussion. Moving posts to new thread.

It is not the first time a manufacturer has made the "Best in Class" claim on one of its products. All major product launches have and will include a "best in class" comparison.
So does the ASCI check each and very statement made by the companies and considered them "technically correct" to make such a response to Nissan India ?

Pretty sure some major player has gotten a blow to its sales figures to go for this tactics.

Skoda really has not rattled any competition in the Indian Market, so everyone must have ignored. But definitely now this may boomerang for the complainants and people start actually giving a thought for Magnite.

I find this really lame ! Since when did advertisements have any soul or honesty to them. rl: They are solely aimed at marketing the product by pulling wool over the eyes of us consumers.

The success of the Magnite must have stirred up the hornet's nest !

Interesting. I did some reading on this. Turns out, legally, one has to show they are "best-in-class" in order to make that claim.

Here are a few examples of it - LINK, LINK, LINK, LINK & so on.

Here's the gist: Often, claims that a product or service is the “best” are unqualified. “Best” claims can be subjective or objective, depending on the claim and the context in which it appears. If the rest of the advertisement does not clarify the criterion used for the claim, authorities may regard the claim as a subjective one. If the criterion for the “best” claim is stated, and that criterion is objective, then the authorities will regard the claim as an objective one, which must be supported by evidence which substantiates that claim.

This is stupidity raise to power infinity..Should I sue Tata Motors if I book Safari and unable to "reclaim my life" thing.

Magnite is good product for its audience base and hope it makes Nissan get other products too to India. Waiting for Renault Kiger to rub it in even more.

This is going to work in Nissan favour for sure, if I was in the marketing team for Magnite - I would have milked this story for sure.

Feels like a kid going to new school and all the students picking on him for being good in studies/sports.

Ford Eco sport - Way above 5 Stars ad should also find a mention here. What is this even supposed to mean.

The Consumer Complaints Council (CCC), an independent body that evaluates complaints received by ASCI, noted that the Nissan Magnite ad and brochure promoted all variants of the car as having the features, while that is not the case.
All variants do not have the features being advertised. And that will be misleading, for sure.

Maybe they forgot to put the * symbol :D

My neighbor is a very silent guy, doesn't talk much and boasts anything. But, he has a Seltos. Yet figuring out where is that Badass with in him that inspired this buy? Who needs to be sued now?

Someone is not happy with the way Magnite is drawing crowds. There are so many ads right from Fair and Lovely, AXE deodorant with lots of false claims. Heck, every other liquid on the stores removes 99.99% of germs. Why aren't they sued?

Great Job Nissan. Keep up the ASC's and Dealers up to the sleeve to enjoy a much better success..

Good move (by launching the magnite), Nissan! Now simply frame an ad out of this thread, to mock the (influencial) competition whose tables you have shaken!

"Some bests are quantitative, some bests are qualitative. We leave it out to our happy customers to judge what's best in class!"

OT: How's this for a resume/pitch? I do write content professionally Nissan, you may consider hiring me if you come across this. :coldsweat
