MorTH issues Draft Notification on end-of-life, fitness & informational tests

MorTH has issued the latest draft notification detailing the Automated and Non automated tests defining End of Life Vehicle (ELV), Fitness as well Informational tests.

Notification covers all types of vehicles including Electric vehicles.

Some points -

1. Test results to be uploaded directly from the test equipment for automated tests.

2. Tests categorized into End of Life, Fitness and Informational with a mix of Automated and Non Automated tests.

3. Tests for ELV in Non transport ICE cars - Headlight beam, Emissions, Steering gear, Brakes.

4. Informational tests are Slip, Suspension, Parking brake, Speedo visual inspection, Malfunction Indicator and Exhaust noise.

5. All other tests are used for Fitness - Headlight assembly, all lights, mirrors, wipers, Battery, Tyres, Seatbelts, Dashboard warning lights, FasTag, HSRP etc.

6. Any tests that failed except informational tests (i.e ELV or Fitness), vehicle will be declared Unfit and owner has 30 days to do retest after rectification.

7. Vehicles failed ELV tests and did not retest within 30 days will be declared End of Life Vehicle automatically.

8. Vehicle that fails fitness tests shall continue to be Unfit and only when it passes all tests (except informational tests) it will be declared fit.

I have mixed feelings on this tests and process mainly because

a. ELV tests seem fine but if it fails in retest (within 30 days), it will be deemed End of Life is too stringent. Does ELV means registration becomes invalid and Unfit means registration will be suspended?

b. Fitness tests seems to be similar to RTO tests done now (mostly visual, functional and not automated) but with private operator. Given the way even a service center fleeces the car owners in India, I am a little concerned about the non automation. Hope there will be visual proofs and recording for these tests.

c. The inclusion of FasTag and HSRP seems to be too much. Especially HSRP is even not adapted by many state governments for old vehicles. If this policy comes into picture by April 2023, vehicles purchased in 2008 or before that don't have HSRP (You cannot even get one in Karnataka for example for old vehicles) will be in soup.

d. I could not get the logic of Informational tests. This is not a free service and why the public should pay for those informational tests if they are not needed for the ELV/Fitness evaluation. Hope this will be dropped. In India, we all know the story of optional packs sold as mandatory accessories during car purchase.

Mods - I created this as a new thread as I think this draft notification provides all these details compared to earlier notifications. If it is not needed, kindly merge it with the Scrappage policy thread.

I am not sure of the implementation, maybe it happens in various regions to various degrees but seems like it's setting a direction for the ministry rather than the exact implementation.

Why ?
1. I am still waiting for the scrappage policy to be executed on ground. I am assuming this will come after that.

2. This policy cannot be all encompassing and implemented across the country in this format.
I don't see any infrastructure although that can come up in 2-3 years.

3. Not sure if HSRP has been implemented across the country yet. In JH it didn't exist till 2017 since our last vehicle doesn't have it and I am guessing its still not executed (else it would make news).

After the scrappage policy and probably this its high time they actually address the elephant in the room, our driving licensing process and traffic rules enforcement.

That would be a noble, essential and long overdue action of greatest public good.

In fact, MoRTH had issued a draft notification G.S.R. 278 (E) on 08.04.2021 on a similar topic. The new draft notification of 25.03.2022 is much more detailed covering many more points for such automated fitness tests. The page no. 29 of this draft notification corresponds to the page no. 36 of the new 25.03.2022 draft notification wherein the last column 7 "Notes for Information" has been added. These notes for information are quite detailed and going through a few of these, I am not sure if even a factory fresh, brand new vehicle would be able to comply with these norms that are most likely copied and pasted from "somewhere" ! The new draft notification has separate guidelines for two wheelers, EV, HCV and LCV fitness norms too. It is 64 pages long as compared to the 43 pages of the older April 2021 draft notification.

Overall, most of the aims and objectives of the two draft notifications are similar. But the "Notes for Information" could prove to be the Achilles heel for many older vehicles undergoing such automated fitness tests. The commercial vehicles that are not so well maintained in general and could face it tougher as compared to privately owned ones. Even privately owned ones could be trapped somewhere.

In case of failure at the automated testing centre, the Appellate authority in such cases within 30 days for appeal against such tests is the concerned RTO where the vehicle is registered.

However, there is no mention of the earlier draft notification of 08.04.2021 getting superseded by this new similar but more detailed draft notification of 25.03.2022 which is normally done in such cases. Does it mean that both draft notifications are effective concurrently and both these draft notifications are due for two separate final notifications ?
