Hello All
I sold my bike to CredR in Nov'17 while I was living in Pune. I was told that the bike will be kept in their warehouse till it is sold off again and after that moment the registration will be transferred to the owner.

But it's been more than 4 years now and the bike is still under my name. The bike seems to be actively used by the number of pending and paid challans.

I have found out the person on Facebook who is using the bike all this time by seeing the challan name and the photo attached with it. I pinged him multiple times but haven't got any response.

I contacted CredR support multiple times (via phone and email) but they haven't given a concrete solution.

What options do I have now? I relocated to a different city in 2019. I only have the delivery note from CredR stating that the bike has been handover to CredR.

Please send CredR a legal notice through a lawyer mentioning your delivery note number and date, stating that if the transfer is not effected within 15 days you will be compelled to file a suit in a competent court to claim damages, compensation for mental agony and seek directions of the court to effect the transfer of the motor vehicle in the new owner's name.

You also need to list each of the unpaid challan details asking the CredR to contact the new owner to pay within the notice period of 15 days.

It will be much preferable to positively file a petition after 15 days if the specific performance sought is not heeded to. It will offer a reason to you for protection from law, as it is now established by a SC ruling that the ex owner is liable if a motor vehicle has not been transferred to the new owner's name.

- As listed in our used car selling article, hope you've sent a copy of all sale documentation (forms, receipts, payment proof etc.) to your local RTO. Do this via Registered Post with AD.

- Send a legal notice to CredD. Your lawyer should draft this. Place all sale-related information on record.

CredR's traffic is abysmal, lesser than even some small & unknown blogs. I have no idea how they are surviving.

Lodge a vehicle missing complaint with the local traffic police stating this is not to locate but for ownership transfer purposes. Worked for a relative in Blr. Once authorities get involved ....

Relax, do not worry. Just file an FIR on CreD and mention that you sold your vehicle but the RC transfer is not being for XYZ reasons. I hope you have the sale related documents. It will be simple if you file an FIR. Do not forget to retain a copy of the report.

I have been through similar condition. The person who bought my bike in 2015 sold it to his friend without transferring the ownership. In my case there was no challans. Just a casual search on Vahan and i came to know the bike was still on my name. Not going much into details, the new owner was thankfully a good guy and we mutually got the ownership transferred but what accompanied was lost time (Pune-Mumbai trips), mental agony and expenditure (mutually shared).
Recently I sold off my Himalayan, I handed over the keys only when the ownership transfer process was initiated, again, the fee for the process was mutually shared.
Try to contact the current owner or as fellow Bhpians, better go the legal way to be on the safer side.

I only got the delivery note(attached) at the time of sale. Hope that should be enough to initiate a legal notice.
I will send the delivery note to the local RTO as mentioned.

Not sure. Maybe you could file locally and then ask for a transfer to a station of your choice.

Was in a similar situation. Had exchanged my old dzire with a new Ecosport at Harpreet Ford, Gurgaon in 2019.
The dealer applied for NOC for change of RTO but the car was still on my name and despite the assurances by the dealer, the car is still on my name as of today.
After the Ford exit, the dealership stopped picking up calls altogether.
So, I heeded the advice of my dad (advocate) and got the RC blacklisted at the RTO a month back. Took about half an hour and was a simple process. So, my liabilities w.r.t the car are over.

Hearing this name for the first time.

Even the mParivahan states the blacklisted status.

Please send a legal notice to Cred. Reach out to the higher ups.

On Team-BHP, we need to stop advocating this practise. Recently, a Bhpian from Pune got a used vento from Mumbai. The previous owner followed the same thing and never informed the new owner about this. The car was blacklisted. With systems going online this will be a major issue. The previous owner had to visit the rto and get it sorted. It’s better to involve an agent when two individuals are dealing and complete the process.

How did sending proof of sale documents to the RTO result in the car being blacklisted. Did the new owner not initiate the transfer procedure?

But this exactly is what will save the previous owner if any trouble arises after the sale, won't it? Did the car get blacklisted because the new owner failed to get the name transfer effected within the prescribed time?

This will not help anyone but just the RTO earn some extra bucks. The original RC was couriered 3-4 days after the sale. During this time the seller sent these documents to the RTO. By the time the process was actually started by the buyer, it was blacklisted. The only thing which can help the seller is the name transfer. No documents sent to rto or delivery note can help the case. That's a misconception.

Just sending documents will not help anyone. After paying the challans, all the documents need to be sent along with the original RC. Appropriate signature of the officer need to be taken to complete the process.
