Re: Helmets to be mandatory for pillion riders in Maharashtra

Just came across this article today. Heights of stupidity! Pune citizens band together to fight against making helmets compulsory for 2-wheelers saying average traffic speeds doesn't require usage of helmet!

This isn't new; the same happened earlier during the first helmets-to-be-compulsory wave (more than a decade ago).

It takes a special kind of stupid to protest a rule that is for your benefit. I don't understand why some multiplexes waste precious minutes on a video highlighting the importance of helmets.

Thankfully, most companies in Pune don't allow two-wheelers inside premises unless both rider and pillion are wearing a helmet.

People are smart enough to get down at the gate and walk in and wait out for their ride back home. Till the time people actually realize the benefit of wearing a helmet and its absolute necessity, nothing will help at all

Pune's anti-helmet circus is now coming to Mumbai

South Mumbai loses its head over helmets.

Quote:
Over 300 residents took out a march and a delegation, which included Lodha, met deputy police commissioner Dnyanes Chavan to discuss the helmet penalty exemption. Chavan told Mirror there would be no change in the enforcement of the helmet rule. “Action against helmetless riders will continue. The law clearly says that helmets are compulsory,” he said.

Re: Helmets to be mandatory for pillion riders in Maharashtra

After failing to implement the law since 2016, the traffic police Additional Director General for Maharashtra State has yesterday, again, released a circular to all police stations in the state, making helmets compulsory for pillion riders on two wheelers. The Section 129 of Motor Vehicles Act, 1988 calls for compulsory use of helmets by pillion riders, but no measures were taken till date by law enforcers in many states and UT's to adhere to the law.

The state police has also now devised two separate categories for imposition of such fines. The pillion will be penalised separately if found riding without helmet. How these modalities will work out leaves a question mark ? The driver has a two wheeler and his licence that show his or her identity. Whereas, the pillion could be anyone.

Quote:
Motor Vehicles Act

Section 129. Wearing of protective headgear. - Every person, above four years of age, driving or riding or being carried on a motorcycle of any class or description shall, while in a public place, wear protective headgear conforming to such standards as may be prescribed by the Central Government:
Provided that the provisions of this section shall not apply to a person who is a Sikh, if, while driving or riding on the motorcycle, in a public place, he is wearing a turban:
Provided further that the Central Government may by rules provide for measures for the safety of children below four years of age riding or being carried on a motorcycle.
Explanation. - "Protective headgear" means a helmet which, -
(a)by virtue of its shape, material and construction, could reasonably be expected to afford to the person driving or riding on a motorcycle a degree of protection from injury in the event of an accident; and
(b)is securely fastened to the head of the wearer by means of straps or other fastenings provided on the headgear.
There are also guidelines in the Central Act for use of good quality ISI certified helmets by riders but there is no enforcement and we find freak plastic helmets sometimes of unusual shapes in use by riders. Also many riders drive without fastening the straps.

Coming to the traffic police, the corrupt ones could now get richer by condoning erring riders by extracting bribes. For the public though the measure is solely for their own safety, there's a lot of inconvenience in store. If a pedestrian friend is spotted he or she cannot be given a lift on the two wheeler without a spare helmet for use. And some RTO's had a few years ago, made it mandatory to buy two helmets in order to register a brand new two wheeler. This may become the norm again.

Also helmet makers ( standard ones and more so the freak ones that outsell the former) are in for windfall profits now that their days have come.

All this only after the implementation is stricter post the few aborted attempts.

Two-wheelers in India to come with 2 ISI certified helmets.

Quote:
Govt. mandates 2 ISI certified helmets with each two-wheeler purchase
A move aimed at curbing casualties in accidents
Meant for the rider and the pillion
Quote:
In an effort to curb the rising toll of two-wheeler accidents, the Indian government has mandated that all new two-wheeler sales must include two ISI-certified helmets. Union Minister has introduced this safety regulation at the Auto Summit in New Delhi, aiming to instill a safety-first mindset for both riders and passengers.
These helmets must adhere to the Bureau of Indian Standards (BIS) safety criteria, marked by the ISI certification, guaranteeing they meet stringent impact resistance, strap durability, and visibility requirements. This mandate designates one helmet for the rider and one for the passenger, recognizing the common practice of two-person occupancy on two-wheelers. By aligning with the updated BIS standards , which prioritize enhanced head protection, the government seeks to integrate helmet provision into the vehicle purchase itself, ensuring buyers are immediately equipped with essential safety gear.
