Re: Helmets to be mandatory for pillion riders in Maharashtra After failing to implement the law since 2016, the traffic police Additional Director General for Maharashtra State has yesterday, again, released a circular to all police stations in the state, making helmets compulsory for pillion riders on two wheelers. The Section 129 of Motor Vehicles Act, 1988 calls for compulsory use of helmets by pillion riders, but no measures were taken till date by law enforcers in many states and UT's to adhere to the law.
The state police has also now devised two separate categories for imposition of such fines. The pillion will be penalised separately if found riding without helmet. How these modalities will work out leaves a question mark ? The driver has a two wheeler and his licence that show his or her identity. Whereas, the pillion could be anyone. Quote:
Motor Vehicles Act Section 129. Wearing of protective headgear. - Every person, above four years of age, driving or riding or being carried on a motorcycle of any class or description shall, while in a public place, wear protective headgear conforming to such standards as may be prescribed by the Central Government:
Provided that the provisions of this section shall not apply to a person who is a Sikh, if, while driving or riding on the motorcycle, in a public place, he is wearing a turban:
Provided further that the Central Government may by rules provide for measures for the safety of children below four years of age riding or being carried on a motorcycle.
Explanation. - "Protective headgear" means a helmet which, -
(a)by virtue of its shape, material and construction, could reasonably be expected to afford to the person driving or riding on a motorcycle a degree of protection from injury in the event of an accident; and
(b)is securely fastened to the head of the wearer by means of straps or other fastenings provided on the headgear.

There are also guidelines in the Central Act for use of good quality ISI certified helmets by riders but there is no enforcement and we find freak plastic helmets sometimes of unusual shapes in use by riders. Also many riders drive without fastening the straps.
Coming to the traffic police, the corrupt ones could now get richer by condoning erring riders by extracting bribes. For the public though the measure is solely for their own safety, there's a lot of inconvenience in store. If a pedestrian friend is spotted he or she cannot be given a lift on the two wheeler without a spare helmet for use. And some RTO's had a few years ago, made it mandatory to buy two helmets in order to register a brand new two wheeler. This may become the norm again.
Also helmet makers ( standard ones and more so the freak ones that outsell the former) are in for windfall profits now that their days have come.
All this only after the implementation is stricter post the few aborted attempts.
