With no offence and with all due respect to pedestrians/legal system, this ruling is biased towards the pedestrians.
With this ruling in place, the drivers following the speed limits on roads can still be penalized for mistake of pedestrians. Pedestrians cannot just jump over the dividers/run across the roads and give surprise to drivers. Also this does not mean, driver should run away when some mishap happens irrespective of whose mistake it is.
We can be a safer country when everyone act sensible towards others.
In other countries, it is taken care by law. But in India, we should take care by acting with due diligence.

The judgment is apt for our country though it remains a question on how this will be enforced or even communicated to the public. And knowing Indians, the pedestrians could also misuse this ruling.

I have myself faced tough times when crossing the roads - both as a pedestrian and a driver. People just don't stop for half a minute to let someone cross the road - they would rather increase their speed, cut into the opposite lane to bypass or jump over a speed breaker, than wait. Zebra crossings in India are literally useless - most crossings without signals will resemble the video posted a few posts earlier.

And, yeah. I do stop for pedestrians and most of the times allow traffic to cross the road because I know most likely nobody else will stop and the guy will need to risk cutting into the traffic. Sometimes I am also a beneficiary of such a rare gesture by other drivers. Feels good.

What about the cases when 'responsible pedestrians' jump across as being suicidal in front of normal drivers who are maintaining their speed as well as their lanes. Brings out the entire onus of responsibility on the motorists. Decisions like these make one question do judges actually move around the country and look at the ground up reality?

An eye opening discussion (and video footage!)

In roads with dense traffic, the pedestrian request signal (button) seems a more practical solution considering the general behaviour of traffic versus ideal. Quoting rules that 'motorists are supposed to' without enforcement actually endangers pedestrians who follow it at face value.

In the absence of zebra crossings, with a steady stream of pedestrians crossing across, I wonder what what is expected of drivers from a rule point of view. While exercising caution at all times goes without saying, the offence takes a different turn post an incident
