Need to see what happens next with Jobs resigning.
It would be a new era for Apple.

Vina, my point was about the phones and tablets being still banned from sale.
I for one read the news that 10.1 should not be sold in EU as directed by a German court and now the smartphones are not to be sold until the photo browsing feature is removed.
So poor samsung is still treated unfairly by blocked sales.
Edit: The phones are banned only in Nederlands, I was thinking whole of EU. Apple seems to have a lot of fan following in media!! |
Very few people know that Android already sells more than i-anything. It is just that no single Android manufacturer sells more than Apple (a situation that perhaps will change soon enough).
Also I'm sure Google lawyers are right now going through their recent purchase - who knows they sue Apple for the "cellphone feature" tomorrow because more likely than not Motorola probably will have a broad (and stupidly granted) patent that would cover it.

The cases are different.
Apple filed a case in Germany where it said that the Galaxy Tab 10.1 violates Apple's design patents and the judge banned the Tab throughout the EU region ( except for the Netherlands where there was already this case running ) without giving Samsung a chance to reply. However, Samsung got the judgement revoked in the rest of Europe later saying the court didn't have the jurisdiction to bang it throughout Europe ( which the judge agreed ). This case will start hearing from today in Dusseldorf.
In the Netherlands court, Apple had filed a much more comprehensive case asking for the ban of the Galaxy phones as well as the Galaxy Tab. The Netherlands is crucial logistically coz all Samsung products enter Europe through the Netherlands. So if they are banned in the Netherlands, Samsung cannot sell them in the rest of Europe. However, Apple has been thwarted in the plan coz the judge threw out the rest of the patent claims and allowed only one claim, while giving Samsung enough time to fix the issues without losing the sale.
Another important ruling was that the judge said the patent on the swipe to unlock feature is not valid as there were prior phones using similar features and Apple's only innovation was that the image slided under the finger when doing the swipe gesture. The judge said that this cannot be patented as this image is "obvious". Apple is suing HTC and Motorola for violating the same patent in the US, so this could provide some ammo to HTC and Motorola in those respective cases.

Already during the previous quarter , Apple sold around 20 million Iphones and Samsung sold around 18 Million smartphones, so it is very likely that Samsung might cross Apple very soon. This is probably the reason why Apple is going after Samsung so aggressively.

This is always a big problem with corporations built round a single giant personality. I do not see innovation dying out immediately (after all some things must be in the pipeline) but it will be interesting to watch. I can see the stock price dropping, so may be Bill Gates or Google can thing of buying out Apple in the not too distant future.
Apple seems to have won the case in the German court in Dusseldorf which had earlier banned the Galaxy Tab 10.1 in the whole of Europe ( later changed to only Germany ) . The court has ruled that the ban would stay and that the final judgement would be given on Sep 9th. This is surprising since Samsung submitted proof that Apple manipulated evidence in 27 cases to make the Tab look more like the Ipad. The judges seem to have bought Apple's explanation that it was a mistake on their part and not really a case of misleading the court wantedly.
I think Apple's ploy of going to court in Dusseldorf has paid dividends. Dusseldorf is supposedly among the most friendly courts in the world for patent litigators ( similar to some regional courts in East Texas where most of the patent cases are filed in the US ).
We need to wait till Sep 9 for the final judgement but Samsung won't be able to sell any Galaxy Tabs in Germany for now.

The raid is about anti-trust complaints in field of search and is not related to Apple
Apple has gone mad and they are getting after shock due to Steve Jobs resignation from company. Everything Apple is thinking of their innovation.
Apple iphone and iPad are just media created hype and Samsung gives consumer much value to their money and features in its product. If this battle will continue both the parties will loose at the end. Samsung also keeps many thing in their hand would exercise their right when thing will go out of control.

Dusseldorf court also ruled they have no jurisdiction over other European countries thus reversing earlier ban in whole of European Union.
Google has passed 10 patents to HTC and now they have sued Apple lets see how it develops. But as I wrote earlier it is not easy for anyone else to get these kind of injunction because of image issue in eyes of non-technical people.
Let's hope Apple doesn't enter the TV market. They would get a patent for a rectangular TV and start suing everyone for making a rectangle with a screen.
