Dad's unrelenting efforts since 8 years to find his 15-year old son's killer traces a Swift owner!

A car killed Mr Jitender Chaudhary's 15 year old son Amit in June 2015 in a hit and run case at Sector 57, near Rail Vihar in Gurgaon. Amit died en route to the hospital. The car fled the scene and the police did nothing since then, other than file a FIR the same day, leading to a criminal case that had no investigations conducted as should have been. Nothing happened in the court of law hence.

The Wazirabad-based businessman found a broken side-(ORVM) mirror and a metal part possibly from the rear of the killer car. His first step was to collect and show these to nearby workshops to find out if any car had come for such replacements/repairs. This is what the cops should have done. Getting no leads from workshops, a mechanic informed him that these components were from a Swift VDI. This proved to be a valuable clue for Mr Jitender who approached Maruti to leave no stone unturned. Maruti informed that the batch number on the rear view mirror glass pertained to a certain car that helped track down its registration number.

As the police FIR of 2015 failed to get things moving through the court, Mr Jitender moved court on his own in early 2016 under Sec 156(3) of the CrPC, but the police were casual enough and said that the accused is untraced and the case had been closed. Hence, the court going by the FIR dismissed the complainant father's case. Mr Jitender thereafter moved the Sessions Court and sought revision of the earlier order. This was dismissed again, but the unrelenting father filed a fresh petition seeking re-investigation of the case. As complainant, Mr Jitender also filed a fresh case against the car's owner Mr Gyan Chand who was traced by now. The police again did some dilly-dallying, saying that the investigation officer is not available. The court took a strong stance now and ordered official inquiry against the investigating officer. The court also directed re-investigation of the whole criminal case after a whole 8 years had elapsed. The police finally filed a chargesheet against Mr Gyan Chand, the alleged culprit.

Most hit-and-run cases end up as "closed and culprit untraceable" files by the police department. Only in some cases are the culprits booked. Mr Jitender Chaudhary's motivated and relentless pursuit to change over from his role as a businessman to a Sherlock Holmes' like detective is commendable. He and his near and dear ones must have been deeply hurt by the irreparable loss of their son Amit, due to which he put all his efforts. And these paid up tracing the car and its driver, who is the alleged culprit and absconder. It sets a benchmark for everyone enumerating what all an individual can do and to what lengths he can go, without the help of any investigative agency, that are all funded by the tax-payer's money.

I can’t begin to imagine what it must be to lose one of your children.
Kudos to the dad of course. At the same time, everything so far is not really evidence, nor does it point to a particular person.

It is unclear whether this mirror is from the car that caused the accident. And even with the car now, apperently, being identified, there is nothing to indicate that the owner was the actual driver at the time.
Hopefully the cops will be able to get some better insights into this case. Not sure what the likelihood is though.

Very sad story.

True, as we are all aware about the court proceedings and possibilities of what good or bad can happen. The alleged accused will try all tricks through his lawyer to outsmart the prosecution. Maybe he is successful or maybe he is not. Since no CCTV camera captures are reported in the news it becomes a bit tough.

As regards whether he was driving or not on that fateful day, this person Gyan Chand will require a dummy driver etc to take the full blame and disprove the fact. Many affluent persons have done this as is well known. We are not sure however as to whether this alleged accused will get someone to masquerade for him as the driver.

Let's hope the victim's father's efforts bear fruits.

Sad state of affairs in India where the police can be bribed to such an extent to let murderers go. I am very sure the Investigiation officer has been paid or influenced to do such a shoddy job in a such a serious case.

Kudos to the father, who despite the apathy shown by the police and courts persisted in brining this case back on track. But now the bigger problem is, how does he
Prove the case against the car owner after 8 years of investigative delay. How much time would it take for the courts to run trail for the accused to extinguish all available legal remedies ? It’s very unlikely a logical end will be reached in the lifetime of the parties.

May god give strength to the family that has lost their kid.

A real life story which will put Bollywood movies to shame!
Whatever course the justice system will take, there would be a sense of redemption in the victim's family knowing they have found the alleged killer.
We should also appreciate Maruti Suzuki's Track and Trace capability that they could track the ORVM serial number to a particular chassis number which ultimately proved to be the crucial clue in solving the case.

Hats off to Mr Jitender Chaudhar who found the strength to pursue this search - in the face of apathy from the authorities. Reflects the sad state of policing in our country.
If Mr Gyan Chand is indeed the perpetrator, hope he gets a stiff sentence.


The news report does not elaborate how Maruti managed to narrow it down to a particular car.
Was it because this car (belonging to a batch with the mirror's batch number) was in the same city and underwent a ORVM change around the time frame of the accident? Which meant some additional intelligent filtering of vehicles of the same batch had to be done either by Maruti or the aggrieved father.

Or is it that the mirrors have a unique number assigned, hence is a simple look was needed to arrive at the culprit's car?

I cannot imagine the loss that Mr. Jitender Chaudhry and his family went through. His relentless efforts highlight one important thing - our criminal justice system for the most part is overseen by morally corrupt police officers. A police officer not investigating a probable murder is one of the worst forms of injustice in a democracy. And the courts not reopening the case of Mr. Chaudhry, an anguished man with full of grief is gross violation of constitutional rights.
Thank god someone in the justice system saw some sense and put the police officer in his place. Hope he sees some form of punishment for his moral corruption and negligence. I will be following this thread for more updates on the case. Hope justice prevails.

I've imagined similar situation at the apathy of our law in bringing justice, especially when we pride to hail from the land of Chozhas, especially the legendary Manu Needhi Chozhan

While such movies are a fantasy, its not only impractical but also unethical & perhaps immoral as well. A Father's love is something expressed in action, not words!!

Whatever happens with the case, this effort a dad will surely give accused person many sleepless nights.

Its possible that person would have come to know about the boys death now , and there is something called as guilty conscience which could be triggered in him.

This case is a big testimony of the lacklustre treatment of an accident case by police in which a human life was lost.. This one should actually make headline in media and around country to set an example.

The Indian Justice system is totally loaded against the innocent while letting the guilty go scot free.
Couple that with the poor attitude, education and pure apathy and there we have a permanently broken system.
Of what use is all us salaried people paying the usurious taxes in the country,’if this is what we have to bear with.

I am studying law and have already had enough experience to offer my two cents here. One of the biggest reasons why our justice system sucks is because of the Police system of India. It is a colonial system that is strictly meant to 'control' (read harass) the common man. The Police in India is basically a hunting dog for the rich and powerful. I am quite sure that if this was someone influential, they would have acted seriously and nabbed the accused within weeks. I can only imagine the pain and despair Mr. Chaudhary must have suffered all these years. All I can say is that I salute his determination and patience.

Really a touching story. Reminded of a similar one few years back by an NRI dad who traced the truck driver who had had an accident where his son was killed. He worked on it for years, dressed incognito, wrote a book on it also. Why cant police do it is, what all of us ask. If you go by newspaper reports, inference is, the chap is moneyed or quite influential and had all the support of the shameless police force. They remain unscathed. And here also with such scanty evidence , atleast by newspaper reports, may go unpunished.

I truly appreciate the efforts of the father. Kudos to his patience, dedication, and persistence. Many culprits go unnoticed and unpunished due to the casual attitude of officials. While it might be just another day at work for them, for a family that loses their child, it is an irreparable loss. It takes strong determination and motivation for a father to apprehend the culprit.

Slightly off-topic, but I seriously fail to understand how the real estate market has been rallying in Gurgaon for last couple of years with such kind of Road Rage, Women safety issues and pollution problems. Is there something that people really see there and feel its still a place where you will pay 3-4 crores and raise your children there?

Hats off to the effort of his dad, but it's a real bummer how messed up our police and justice system in India are, not to mention the justice system. It's anticipated that it will take another eight years to prove his guilt. Furthermore, it appears quite manageable for the person to escape from his trial. As far as I can see, there is no proper evidence for this trial, and there are numerous loopholes . I hope his effort doesn't go to waste.

If one police officer had done their job properly in 2015 by collecting evidence and such, the case would have been closed long ago. All it takes is just one person to work diligently in their job, especially when their salary is funded by the same citizens who were affected.
