The salvage buyer came yesterday to tow away nexon. He's offered 2.8L for it. But, we've lost the RC during flood, when car was immersed in water, driver window opened up(supposedly a security feature) and the document bag got lost.
At the last minute he backed out of the deal and asked to wait. Now insurance surveyor is in a pickle too.
Meanwhile another salvage buyer approached me directly. Offering 3-3.5L for the car. Since it was working out properly with the first buyer, I didn't entertain this guy, plus when spoken to surveyor, he said second buyer wasn't insurance approved, might not be reliable and may back out and I'd end up holding a dead vehicle which could be worthless.
I do not know personally any of these salvage buyers. Both of them agreed to transfer money via RTGS and only after the complete payment received (minus the duplicate RC holding amount) will they tow away the vehicle.
Now,
1. If I now insist with the surveyor, can he legally object and deny? Can I instead go ahead with constructive loss or something and get the (IDV-2.8L) amount from insurance for retaining the vehicle?
1a.How will the insurance determine the salvage cost?
1b. In case if I retain vehicle right now, and next week my new buyer backs out, will I be able to find another buyer easily enough? Or will I end up holding short end of stick?
2. Both the buyers were holding 10-15K for duplicate RC. Is this a standard practice? Can't the ownership transfer work out with "vehicle particulars"?
3. police station doesn't have a online FIR system currently IMO and they aren't issuing FIR for lost rc. Dad had been there last month two days, will follow up again today on an urgent basis.
4. Insurance clause states that the buyer may not profit from this situation. So, no matter who buys at what price, I am going to get max IDV and no more. but, in case of a bidding situation like this, is there a chance of some underhanded benefit? Or, by retaining the vehicle, can I sell it at higher cost later?
