Re: Beware 'Out of State' cars: RTO (Bangalore) taxation amendment from 28th Feb, 201

Looks like there was another RTO drive at Chandapura, Bangalore Rural Dt. Saw lots of two wheelers and high end cars pulled over to the side.

These guys are on a rampage. They are catching out of state cars that come in for service at Trident Hyundai at Krpuram.

Over the weekend, they set up camp just outside Prestiege Shantiniketan apartment entrance. Families are sure to head out to the mall or an outing. You are jacked the moment you get out of your apartment.

Re: Beware 'Out of State' cars: RTO (Bangalore) taxation amendment from 28th Feb, 201

svsantosh has shared this information:

Hosur Success Story
------------------------------
Mr.V, ECity Employee, TN02 (Chennai regn), but shifted to hosur many years ago

24-July-2014, Caught by RTO Squad in ECity Infy main Road and car seized and sent to Bannerghatta Road ECity RTO

25-July, Mr.V went to RTO with all HOSUR ADDRESS PROOF Documents like Voter ID Card, LPG Connection, Telephone Bills - got car out SUCCESSFULLY without paying a paisa and managed to CONVINCE RTO the reality of his situation

PS - HOSUR CAR OWNERS who cross ATTIBELE Toll frequently - I walked into Attibele toll HQ and they said the data dump is available only at Ecity HQ (next to DMart)and ask the person for a data-dump of your car number for last 3-6 months to prove how often you travel across attibele and out of KA.

PS PS - Left most lanes have the hand-held ticket issuer - AVOID those lanes and insist the toll-receipt have your car number spelt out clearly and not abbreviated with last 4 digits alone.

In response to your post, BHPian Dry Ice has the following to share:

Quote:
Here is the relevant section from the Karnataka Motor Vehicle Taxation Act -

18. Utilisation of the proceeds of taxes.- The Head of State Accounts
specified under section 17, shall be debited under the order of the State
Government, with the following charges, that is to say:-
(i) such amount as the Government may, by order determine on account
of the expenses incurred in giving effect to the provisions of this Act;
(ii) payments made to local authorities under section 20; and
(iii) allotments made by the Government for such other purposes as may
be consistent with, or necessary for, the more efficient administration of this
Act.

Clearly, there is nothing to mandate a fixed % is spent on roads/infrastructure.

Re: Beware 'Out of State' cars: RTO (Bangalore) taxation amendment from 28th Feb, 201

BHPian theexperthand has the following update:

I paid my tax yesterday at the ECity RTO and the procedure was almost same as SVSantosh mentioned.

1) Go to room 6 with a Form 14, Invoice and copy of your RC book and Insurance (in my case, the officer didn't even glance at the RC copy or insurance copy, but do keep them with you).

2)Once the road tax is calculated, take a DD for that amount from ANY bank and go to cash counter (counter timings - 10.00 AM to 2.30 PM on weekdays and 10.00AM - 12.30 PM on saturday)

3)Once you get the Tax paid receipt in duplicate and form 14, go to room no 5 and hand over the Tax receipt duplicate and Form 14.

Few Points:

No need to produce an address proof.

NOC is not required, how ever the officer in room no 6 will ask if you have NOC.If you say you do not have noc, he will just not it down on the form 14.
You do not need to speak in local language - be polite and state your case in English to the officer in room no 6. I stated my case entirely in English and did not get any fine amount. I just had to pay the tax and the surcharge.
Form 14 can be downloaded from here - http://rto.kar.nic.in/kmvt-14.pdf

svsantosh has shared an update to his post above:

Apologies for incorrect 'input'

Neither ECity or Attibele Toll Office will give a Data Dump of a vehicle # to just any person like that - it needs a FIR and other documents.

TIP - If you really are a frequent user of Attibele Toll booth - get a Prepaid card/Monthly Pass only then the give you a usage report of the debits on the card.

Re: Beware 'Out of State' cars: RTO (Bangalore) taxation amendment from 28th Feb, 201

Kumar R shares the following information. Thanks!

Quote:
One interesting aspect of the Karnataka law on lifetime tax in that the tax is payable if the vehicle is

"in the state for a period exceeding thirty days"

whereas a refund of such tax shall be given only on:

"(i) removal of the vehicle to any other State on transfer of ownership or change of address; or

(ii) cancellation of registration of vehicle on account of scrapping of such vehicle due to accidents or other causes."

In other words, the tax is leviable even on persons who do not effect change of ownership / address to Karnataka but to claim a refund it is necessary to change registration to some other state. Some dichotomy!

This article came up today.

http://www.bangaloremirror.com/banga.../40380206.cms?

One thing is wrong in that when you pay the fine, you should have the option to pay up or remove the car from the state
