So RTOs in Delhi, Haryana, Pune are/were registering the BS4 cars sold before the lockdown and adhering to the SC stipulated deadline of 30.04.2020. What is surprising that they just decided to open in last 2-3 days and cover up the pending cases.

I had an extended harrowing experience with one of the RTOs in Delhi for last two days, as they were insisting to register only those cases whose files had physically reached them before 22.03. Finally with intervention of seniors in transport ministry, the matter was resolved and did they start processing all the concerned files.

The Form 22 mentioned the emission standard as BHARAT 4 & 6 and may be this has caused some confusion. All the Merc BS6 vehicles were getting registered as BS4 and BS6 for sometime, don't why this is an issue for Kothamangalam RTO now. My C220D, registered last year has it the same way.

I have bought a BS4 Activa in March last week in Tamilnadu. RTO and Insurance is paid before 31-March. Due to lockdown, it is not registered in RTO till date. While contacting dealer, he mentioned that some notification is yet to be given by the center. Any idea whether other states are registering the BS4 vehicles or notification by central govt is still pending?

SC bars sale, registration of BS IV vehicles.

On March 27, the Supreme Court had extended the March 31, 2020 deadline for the sale and registration of BS IV emission norm compliant vehicles on account of the “extraordinary” situation caused by the 21-day lockdown due to the COVID-19 pandemic.

The court had divided the BS IV vehicles inventory into two broad categories – vehicles which were sold before March 31 and not registered; and vehicles which remain unsold with the dealers. As far as the first category, ie, BS IV vehicles sold before March 31 but not registered, the court said they could be registered after the lockdown was withdrawn. As for the unsold BS IV vehicles, dealers were allowed to sell 10% of the stock after the lifting of the lockdown. However, dealers in Delhi NCR were barred the relief owing to the high levels of the pollution in the National Capital.

The court said its March 27 order giving leeway for the sale of 10% of unsold BS IV stock was “misused.”

The court also said it was startled by the turn of events. It further sought details of the BS IV vehicles sold up to March 31.

The dates of the sales should be specified. It said the government should specifically collect details of “two-wheelers, cars and other commercial vehicles and the sales made after lifting of the lockdown under 10% throughout India. It be also specified whether sale of vehicle was specified on E-Vahan portal of Government of India as on March 31, 2020”.

Bharat Stage (BS) emission norm is a standard instituted by the government to regulate output of air pollutants from motor vehicles. The BS-IV norm has been in force since April, 2017.

God help the ultimate buyers if the Hon'ble SC severely penalizes FADA & dealers who knowingly sold far more than the 10% allowed.

Next hearing is on 23 July before which full details have to be furnished to the Court.

Supreme Court extends ban on registration of BS4 vehicles

The Supreme Court of India has banned registration of BS4 vehicles sold during the lockdown until further notice. The court also noted that an unusual number of BS4 vehicles were sold during the lockdown and the hearing on the same has been scheduled for August 13, 2020.

On March 27, the Supreme Court had passed an order allowing dealers to sell 10% of unsold BS4 stock for 10 days after the lockdown was lifted. However, the court found that dealers had violated its directives and sold BS4 vehicles during the lockdown.

The court noted that 2.55 lakh BS4 vehicles were sold after March 27, when only 1.05 lakh vehicles were allowed to be registered. The court had directed the Federation of Automobile Dealers Association (FADA) to submit details of the BS4 vehicles sold during this time to the Ministry of Road Transport & Highways for verification. However, details of only 17,000 vehicles were uploaded on the Vahan portal.

The court had recalled its order earlier this month and had allowed registration of those vehicles whose details were uploaded on the e-Vahan portal till March 31.

I can see this going the way of the telecom AGR case. After the case goes in the govt's favor, only then will they realize what a crushing blow they've dealt to the industry, and then they will plead with the SC to go easy on the enforcement of the order.

While I respect the Supreme court and their judgement usually, this is just too harsh.

Ok, so what if the automakers sold a lakh more BS-4 vehicles? These were the same BS-4 vehicles that were sold in millions every month over the last few years. And we still have so many out dated lorries which are probably not even BS-1 compliant plying on our roads. Industries continue to pollute the air without a care as always.

I am not defending the auto makers, but we have to be fair with them too. They have taken a huge hit due to this COVID-19 crisis, and are already struggling. They have been paying their employees even during the lock-down eating up all the loses - which neither the Supreme court, nor the Government came to their rescue!

While there are so many blatant violation of rules happening across the country in various sectors from Education to Medical to Insurance sectors, it is just not fair to target an already suffering industry like this!

I am still not able to understand the problem. Dealers were sitting on an inventory of BS4 and the numbers were shared in March. Whatever was not sold, dealers/ manufacturers got billed to themselves before 31st March, so where have the rules being broken? Or did the dealers sold Euro 4 after 31st March?

I am not aware of any such sales by premium car or bike manufacturers at-least.

Your assumption is correct. Supreme Court is taking issue with BS4 vehicles that were sold and registered AFTER 31st March and wishes to cancel their registrations at the least or penalize the manufacturers and dealers. Any vehicle registered on or before 31st March is fine (whether registered to customer / dealer / manufacturer).

SC should atleast allow us to register the vehicles for which the road tax, insurance are paid before 31-Mar. There are many customers who are suffering because of this.

I believe the lockdown started 23rd March ? So technically this is valid only for sales before the lockdown and where registration is still pending. The other SC order for 10% of vehicle sales during and after lockdown still stands withdrawn ?

Attached is the Supreme Court Order dated 13th August 2020 which I received over WhatsApp, what I could deduce was
1. Co Dealer Sale BS4 Vehicles cannot be registered.
2. BS4 Vehicles whose Details are Not Uploaded on Vahan Portal cannot be registered.
3. BS4 Vehicles whose details were uploaded on Vahan Portal or those whose Temperory Registration was done will be allowed to be registered.
4. No Registration of BS4 Vehicles in Delhi NCR post 31st March 2020.
