@paliontile, totally agree to your point, since no signals were there, so in all respects some common sense among the affected parties would have been useful. Under no circumstance majorly at night any vehicle should be driven so much insane. As per the footage, let alone the right of way and any other consideration, it's purely evident that omni's driver saw the approaching disaster very late as he was more focused on the santro in front. Lucky Guy; Santro, saved by just inches else it would have been more gruesome.

Now, The part of whether city could have slowed/stopped at crossing. I feel by the footage, the driver was not attentive and reacted very late Reasons best known to City's driver. At the inevitable juncture, the city was now so close that no option could have worked and the omni's driver till the last moment was unaware of the forth-coming. As you may see the video, the omni's driver did not even try to save the vehicle.

Right of Way in my opinion is subject to the conditions; see, assess and make the move.

Oh god. This is actually beyond horrific. What car is this? looks like a Chevy Beat and notice he brakes only a second before impact. There was no way anyone could have survived this.

You would call this more of a suicide bid and not accident right? Either driver totally took eyes off the road or the brake did not work properly (apart from the possibility of him being totally drunk).

Yes. The way he approaches the trailer could give that impression. I guess this is distraction + speeding + possibility of DUI and sighing the trailer late due to the hieght difference.
