Steer, I was wondering about this.
Some nut hits my car, damages it and gets off without paying a dime, while I either pay full from my pocket or claim insurance and pay a part and also end up loosing NCB. Thats not fair.

So, to go the way you suggested, what are the steps I should take to ensure that I can claim from his insurance, thereby not loosing my NCB ?

Police case is required. Only then will his insurance co pay for your damage.

Steer, I think you've been living outside India for too long! That's how it should work. I suppose with the so called de-regulation of the insurance sector, these sort of things should fall into place within a year or two.

Till then, we are basically paying out of our own pockets one way or another.

Exactly what i had mentioned earlier. Not that we can help it all that much, but not all other drivers are co-operative. Running after them, and all only wastes your own time and effort.

Vid was lucky that the Innova guy who damaged his car agreed to pay up.

OFF TOPIC : Guys, have you noticed that offlate on the forum we see a lot of innovas which are being involved in accidents? Ex : Vidyut's case, Rudra's case, Riju's incident, and so on.

IMHO, both.

Manufacturers have to give better brakes, and more importantly better rubber. I drive a Nova (not Innova ) and people complain about the brakes. Actually, the brakes are pretty good - I can easily lock my wheels. It's the rubber that lets me down - I can easily skid my vehicle on good dry tarmac even without locking the wheels.

Two-wheeler drivers (myself included) must also learn the limits of their vehicles:
  • Two wheelers have better startup acceleration than four wheelers
  • Once four wheelers get rolling, they have better acceleration
  • Four wheeler brakes are easily an order better than two wheeler brakes (think hydraulic assist)

She's back

Got her back today. No impact beam damage.
Total cost 19053/-. Insurance paid 11784/-. My payment 7269/-. Repair job looks ok to me.

Nope. This was told to me by the National Insurance agent when he came to renew the premium on one of my cars and I had lost the no-claim bonus for having claimed a small sum of Rs.6,000. When I mentioned it was no fault of mine he asked me very clear 'Sir why did you claim it from his insurance company then? You wouldnt have lost your no-claim bonus'.

I may have been living outside India for too long, but that insurance agent certainly hasnt been outside the country!

AND BTW OLD MAN - GOOD TO SEE THE CAR BACK IN GOOD SHAPE. SORT OF MAKES EVERYONE'S DAY HERE.

Rudra-sir, Nice to see your car back like new.

But it still rankles that you shelled out money for some other a*s' mistake. I still believe you should have taken him to task. And this is not only for the money, but so that he knows such tricks will cost him dearly and will hesitate repeating it.

So, given the above, I guess if the damage to our car is serious and costly, we should file a case and have that guy invoke his insurance. Though how events will unfold in an actual scenario, can be known only then. Unless someone on the forum has used this method and can enlighten others.
