re: Nissan chairman Carlos Ghosn arrested in Tokyo. EDIT: Carlos escapes from Japan!

Things not looking good for Ghosn, indicted on yet another charge, this time on aggravated breach of trust to keep him detained. Some more allegations from Nissan and Kyodo.
Quote:
Nissan on Monday said it had filed a criminal complaint against the former chairman, saying it had determined that some of its overseas payments had been ordered by Mr. Ghosn for his personal enrichment.
The payments were “not necessary from a business standpoint”, Nissan said in a statement, adding: “Such misconduct is completely unacceptable, and Nissan is requesting appropriately strict penalties.”
The Kyodo news agency has previously reported that the losses involved the shifting of funds through a dealer in Oman to the account of a company Mr. Ghosn effectively owned. The agency did not cite any sources.
Sources have previously told Reuters that Nissan partner Renault SA has alerted French prosecutors after uncovering suspect payments to a partner in Oman.
Evidence sent to French prosecutors showed that much of the cash was subsequently channelled to a Lebanese company controlled by Ghosn associates, the sources said. Mr. Ghosn’s French lawyer has denied the allegations.

Definitely, more trouble for Ghosn. Now that he is not on the board (of Renault and Nissan) as well, he will be forgotten soon and will become a news piece. Nissan is pressing hard to keep him in Jail and Japan is supporting equally.

He should have kept his mouth shut after he had gotten out and allowed things to cool for a while. This would have also allowed his new team of lawyers to figure out a way forward without too many distractions.

In the meantime, he should have allowed all media blitzes to be run by his wife instead of him opening his mouth all the time.

He's just making things very tough for his lawyers. The rearrest was fundamentally Japan's way of shutting him down.

Carlos Ghosn, ex-Nissan chief, granted bail in Japan, again.

A Tokyo district court announced that Ghosn was granted bail at 500 million yen ($4.5 million).

Quote:
Nissan declined to comment on Ghosn being granted bail, saying that an internal investigation "uncovered substantial evidence of blatantly unethical conduct

. In line with Red Liner's post, I think this time he is going to keep his mouth shut. There must have been backdoor discussions between the authorities & him, with Carlos agreeing to keep mum. At least for a while.

Yes, he will surely keep mum this time. This looks like an agreement between the Japanese and the French authorities. It is the France government (largest shareholder in Renault) that is pressing for a merger and they were attempting it through Ghosn. The attempt backfired and Nissan nabbed Ghosn badly. Now there is no way Ghosn is getting out of this mess scratch-less. The current bail is definitely a back door agreement to save Ghosn and then kick him out of the equation completely. He will be a 'nobody' in a couple of months.

Ms Carole Ghosn had made statements about the safety and well being of her husband Carlos, who was lately in Japanese custody till he was released on bail after paying a huge amount.

One of the conditions to bail was he has no more interaction with his wife.

Only Japanese can play with Japanese. They are very hostile to outsiders, and Renault getting a bigger bite didn't go too well with Nissan.

Same thing happened with VW-MS in India. And on the other side, you have Toyota gelling well with MS today, and Toyota-Subaru-Isuzu fraternity in many markets, and soon to include Suzuki in this equation, in my opinion atleast.

Toyota being Toyota managed to get BMW diesel engines on their Euro products. A rare win with outsiders.

The latest fallout after Carlos Ghosn's arrest-bail-arrest-bail episodes and so on is that his successor CEO Hiroto Saikawaat Nissan is finding it tough to sail through, with profits plummeting.

Link to the newsitem :

https://auto.economictimes.indiatime...mmets/69300347

Some excerpts:

Quote:
Troubled by slumping US sales, aging models and a product cycle that’s out of sync, the Yokohama-based company is on track to announce on Tuesday its lowest annual operating profit in a decade, raising the possibility of a dividend cut. The outlook for the current fiscal year to March 2020 probably won’t be any more promising.

Chief Executive Officer Saikawa has yet to announce a turnaround plan since the arrest of former chairman Ghosn in November, and people familiar with the matter say there’s internal strife over whether he’s the right executive to fix Nissan. Alliance partner Renault SA may not look too favourably on Saikawa’s reappointment if he continues to oppose a merger said to be backed by its own chairman Jean-Dominique Senard, who is also a Nissan director.

In addition, alliance partner said it would block Saikawa’s reappointment if he didn’t agree to a merger a request made by Renault’s new chairman that Saikawa batted away, the Yomiuri newspaper reported last month.
Nissan's Indian model portfolio is also none too good. The Evalia could'nt catch up with the market likes and neither the others incl. Terranos, Gos and Redigos are doing any better.

It's not just Nissan. Now, the French / Renault want to file a complaint against Ghosn for financial misconduct (which is a polite way of saying you STOLE money from the company for your own personal expenses):

The finance minister of France, which holds a 15 per cent stake in Renault, said Wednesday the auto giant plans to bring a case against former chief executive Carlos Ghosn after identifying 11 million euros of questionable expenses. The prospect of new legal action backed by France marks a new headache for the former Renault CEO, who was also Nissan chairman in the alliance with the Japanese carmaker, after his arrest in Tokyo in November.

The fraudster that Carlos Ghosn has turned out to be, its astonishing to comprehend as to how his methodologies adapted to cheat the MNC's went unchecked. These MNC's have "big name" external auditors. They must be having internal auditors as well and its intriguing to know as to how such huge sums involved, bypassed the so many audit scanners. It amply illustrates that Mr Ghosn must be having helping hands to aid him to hoodwink and cheat the big MNC's.

Carlos Ghosn sues Nissan-Mitsubishi for Euro 15 million

According to a media report, Carlos Ghosn has filed a lawsuit against his former employers Nissan and Mitsubishi in the Netherlands, seeking Euro 15 million in damages.

Nissan chairman Carlos Ghosn arrested in Tokyo. EDIT: Carlos escapes from Japan!-carlos-ghosn.jpg

Ghosn's lawyer has reportedly said that Nissan did not give prior intimation about its decision to sack his client and neither provided any evidence to support its accusations against him.

Reports suggest that the district court in Amsterdam is reviewing the case but has not set a trial date yet.

Ghosn was arrested in Japan last year on charges of financial misconduct. He was later released from jail on a US$ 4.5 million bail.

Nissan and Mistubishi have accused Ghosn of improperly receiving $9 million in compensation from their joint venture. He is also suspected of spending Euro 11 million, while he was heading Renault and Nissan.

I Fail to understand this step from Ghosn. Why would he want to sue Nissan and Mitsubishi when they can easily accuse him of one more fraud at NMBV and then this whole thing can back-fire.

He was first sacked from RNBV when an audit pointed out at financial discrepancies and then from NMBV as well, though Nissan or Mitsubishi never gave any explanation on this. They can easily conduct one more audit at NMBV and look for fishy things. I am sure they will get something or the other to hold Ghosn accountable and then he will face one more charge. Silly step from his legal team.
