Tweaked Motor Vehicle Rules to allow adding nominee in RC

While an owner can name a nominee at the time of registering a new vehicle, owners of existing vehicles, have to make an online application to have a name of a nominee added to the registration certificate. If the owner of a vehicle wants to change the nominee, it has to be done by following an agreed Standard Operating Procedure (SOP).

The Ministry of Road Transport and Highways (MoRTH) of the Government of India has issued a notification about some alterations made in the Central Motor Vehicle Rules, 1989. The alterations allow the addition of a nominee in the registration certificate of the vehicle.

At present, if the owner of a vehicle passes away, the transfer of the vehicle is a tedious process that requires many formalities to be completed and various government offices to be visited. This change in the Motor Vehicle Rules is expected to make the procedure easier.

The notification also states, "Where the owner of a motor vehicle dies, the person nominated by the vehicle owner in the certificate of registration or the person succeeding to the possession of the vehicle, as the case may be, may for three months from the death of the owner of the motor vehicle, use the vehicle as if it has been transferred to him, provided that such person has, within thirty days of the death of the owner, informed the registering authority of the occurrence of the death of the owner and of his own intention to use the vehicle."

Within three months of the owner’s death, the nominee will have to fill Form 31 and apply for transfer of ownership to the registering authority.
