Re: Classic Cars available for purchase

Hi friend's and mods,

I am not sure if this is the right thread to enquire or write.
Mods please move this to appropriate thread.

I have few questions and need your help or rather advice to know tax payments for classic cars, fitness cirtificate and change of ownership.
I am finalizing a 62 model fiat select car which has a single owner on rc book but the owner is not alive. His son is looking to sell it. The issue is that the car is not used since 15-18 years and taxes not paid since the time..
What should be the procedure to get it onto my name and how much will it cost considering the penalties and insurance.
I feel that the ownership will have to be changed to son by affidavit and then onto mine.
But what should be the procedure, time and tentative cost to my pocket.
Thanks in advance.

Not really specific to the case, but the general procedure would be - The legal heir would be required to submit the death certificate of the deceased owner, a survival certificate of the heir, a family tree + an noc from the legal claimants declaring their non-objection to the car being transferred.
The ownership will then be transferred to the legal heir, who can then sell it to you.

The cost will probably be around 10k, which includes the insurance, green tax, FC and transfer charges.

I would suggest that along with the current owner go to RTO and ascertain the the cost to get the updated book. You may get a rude shock by the figure that will be quoted. This being a State subject, the total cost will vary from State to State. Remember penalty under the new MV Act is prospective and not retrospective. Once you have a fair idea on the cost, then make your final offer on the car

The legal heir is the spouse, if not predeceased. You need to submit Survivor Certificate and not the Family Tree. Otherwise you are correct schakravarthy.

Cheers

Srinivas and KPS,
Thank you for your insight. Sure I will be looking at the options and will get in touch with RTO so as to get things sorted out and my calculations before getting hands over the Italian.

Re: Classic Cars available for purchase

Dear shabaaz
My experience of getting the vehicle transferred from deceased person.
I bought an ambassador where the owner was deceased.
RTO formalities of Mysore (Karnataka)
1. Got the Family tree ( to know the root of the owner) from corporation office
2. Got both the son's signature on affidavit
3. RTO wanted physical presence of both sons ( despite bribe)
4. Fitness was due for 6 months, fine of Rs 500/- per month now (new rule), so Rs 6000/-
5. For transfer of owners of deceased person fee Rs 3000/- (normal under rs 1k)
6. Insurance Rs 8K
Total it costed Rs 18K (since FC was late only for 6 months & Life time tax was paid already) , Broker Rs 3.5K, aprox it took 10 days.
Hope this is useful. Since Rules are state specific its better to get the complete details from local Agent.
