Finally, a bizarre case is grinding to a close, but after leaving indelible scars.

I would like to ask our lawyer friends here, why is there never a case against LEAs in our country? If there ever was a case to prove arbitrary use of the law, amounting to conspiracy to protect the guilty, this is a shining example.

Even in higher profile cases, the defendant thanks his/her stars when they regain their freedom, but there is never a penalty to pay for the other side.

Do government officers enjoy indemnity, or our civil society is just too weak?

As a lawyer with experience in criminal law, let me attempt to answer this question. The straightforward answer is that LEAs face no penalties for gross incompetence or mistakes. As long as their actions are taken in good faith, they are generally immune from consequences. Even in the case of botched investigations, as long as the intent behind the action was right, there are no repercussions for the LEAs.

Where you might have a case is if you can demonstrate that the law enforcement agencies unfairly targeted you due to personal vendetta or other improper reasons. If there is evidence that you were falsely implicated because of enmity or any extraneous motives, it could lead to criminal proceedings against the LEAs. However, simply proving a poorly handled investigation or wrongful arrest won't result in penalties for the agencies involved.

Only yesterday, the Supreme Court in a case, observed: "Some day, the courts, especially the Constitutional Courts, will have to take a call on a peculiar situation that arises in our justice delivery system. There are cases where clean acquittal is granted by the criminal courts to the accused after very long incarceration as an undertrial… In a given case, it may amount to violation of rights of the accused under Article 21 of the Constitution, which may give rise to a claim for compensation."

So even Supreme Court has started talking about this issue, but change is a long way ahead. Also if I were to be hyper-technical, this only speaks about issue where person was in jail for a long time and then acquitted. It has nothing about shorter periods of arrest during. course of an investigation.

Right now, therefore, the only action lies against malicious prosecution.

To my Team Bhp family. Good news.

Asterix is home. A little bruised a little scarred but finally home. Started on first crank almost eager to leave that dreadful police impound. I sat inside and drove it today after the 28th of July when I was asked to join the investigation..and then arrested.

The next few days will be spent cleaning it up inside and out and giving it a full service.

Welcome home son.

It's great to hear that that Asterix is back home. And from now on don't even drive within a kilometre radius of a waterlogged area. We are easy culprits incase any mishaps happen. So were the glasses rolled up or were they rolled down ? And hope you don't mind, but all those leaves on the bonnet actually look good. It seems as if it has came back from a jungle trail.

Hope you have a great journey with Asterix from now on.

Till we have enough laws to sue the Police/Government for damage to the reputation and personal property, we are very very far away from being a developed country.

Congrats for getting your prized possession back.

Infact, today morning only at a colony park, happened to meet the wife of the original owner of Rau's IAS Study circle, Krishna aunty, whose son-in-law (CEO) was arrested after the unfortunate incident in July.

Really unfortunate how the law enforcement agencies worked in the present case.

The CBI has filed their chargesheet and have removed my name from the case stating that no case is made out against me.

Thanks for all the love and support these past months my brothers.

Today finally Asterix and i both are putting the events of the past few months behind us and
moving on!

Thank God. It is good to know that though it may take time, justice and truth often (if not always) do prevail in this world.

The rims look good and as alloys go are about the strongest design available. Source? Any idea of weight vs. stock steel?

Thank you for your good wishes. Yes its indeed a huge huge relief.

The Alloys are the same Plati wheels i was using earlier. They started off black and i had them painted Bronze as you may see in my first post in this Thread.

Just had them painted Off white and have removed the hub caps for now. They are far lighter than steelies. Zero Offset, 8.5 inch wide and have a 110 center bore.
